RESOLUTION NO. 2024-131R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS AUTHORIZING A LOCAL ON-SYSTEM <br /> AGREEMENT ("LOSA") WITH THE TEXAS DEPARTMENT OF <br /> TRANSPORTATION, RELATING TO THE BRIARWOOD AND RIVER <br /> RIDGE DRAINAGE IMPROVEMENT PROJECT, TO PROVIDE FOR <br /> NECESSARY CONSTRUCTION OF A DETENTION POND OUTFALL <br /> ALONG THE IH-35 FRONTAGE ROAD, IN THE AMOUNT OF <br /> $584,065.00; AUTHORIZING THE CITY MANAGER, OR HER <br /> DESIGNEE, TO EXECUTE THE APPROPRIATE DOCUMENTS TO <br /> IMPLEMENT THE LOSA ON BEHALF OF THE CITY;AND DECLARING <br /> AN EFFECTIVE DATE. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS,TEXAS: <br /> PART 1. The project description and location for the local on system agreement with <br /> the Texas Department of Transportation (TxDOT) is to construct a reinforced concrete pipe <br /> and box culvert detention pond outfall across the southbound IH-35 frontage road between <br /> Briarwood Court and River Ridge Parkway. <br /> PART 2. The estimated construction cost is $584,065 and is funded by the Texas <br /> Water Development Board. The City is responsible for 100%of cost overruns. <br /> PART 3. The City of San Marcos will not build this outfall until TxDOT's plan <br /> approval has been obtained. <br /> PART 4. The City of San Marcos Engineering and Capital Improvement Department, <br /> and consultants will ensure the detention pond outfall are constructed in strict accordance with <br /> the approved plans. <br /> PART 5. The City Manager, or her designee, is authorized to execute appropriate <br /> documents to implement the TxDOT Local On-System Agreement on behalf of the City. <br /> PART 6.
