RESOLUTION NO. 2025-86R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING AMENDMENT #1 TO THE ADVANCE <br /> FUNDING AGREEMENT (AFA) WITH THE STATE OF TEXAS, <br /> THROUGH THE TEXAS DEPARTMENT OF TRANSPORTATION <br /> (TXDOT),FOR THE SAN MARCOS SHARED USE PATHWAY PROJECT, <br /> TO INCLUDE ADDITIONAL COMMUNITY PROJECT FUNDING <br /> (CPF)/CONGRESSIONALLY DIRECTED SPENDING (CDS)/EARMARK-) <br /> UNDER THE HIGHWAY INFRASTRUCTURE PROGRAMS (HIP), <br /> AUTHORIZING THE CITY MANAGER, OR HER DESIGNEE, TO <br /> EXECUTE SAID AMENDMENT; AND DECLARING AN EFFECTIVE <br /> DATE. <br /> WHEREAS, on October 26, 2023, via Minute Order 116575, the Texas Transportation <br /> Commission authorized the San Marcos Shared Use Pathway project (CSJ: 0016-03-128) (the <br /> "Project)to receive Transportation Alternatives Set-Aside (TASA) funds for project construction <br /> and Texas Department of Transportation (TxDOT or the State) oversight; and <br /> WHEREAS, the city council of the City of San Marcos approved a resolution on June 4, <br /> 2024 authorizing the execution of an AFA with TxDOT for the Project, which was executed on <br /> August 5, 2024; and <br /> WHEREAS, additional Community Project Funding (CPF)/Congressionally Directed <br /> Spending(CDS)/Earmark)under the Highway Infrastructure Programs (HIP) was awarded to the <br /> Project; and <br /> WHEREAS, City of San Marcos will provide the 10%local match required for funds; and <br /> WHEREAS, City of San Marcos is responsible for all non-reimbursable costs and 100% <br /> of overruns, if any; and <br /> WHEREAS,the Governing Body of the City of San Marcos desires to reaffirm its support <br /> of the Project and approve and authorize the execution of Amendment#1 to the Advance Funding <br /> Agreement (AFA)with TxDOT for the Project;NOW, THEREFORE: <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The attached Amendment #1 to the Advance Funding Agreement (AFA) <br /> between the City of San Marcos and the State of Texas through the Texas Department of <br /> Transportation for the Project to include additional Community Project Funding (CPF)/ <br /> Congressionally Directed Spending (CDS)/Earmark) under the Highway Infrastructure Programs <br /> (HIP) is hereby approved. <br />
