r� <br />• <br />• <br />RESOLUTION 2009 -176R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AUTHORIZING THE TEXAS HOUSING <br />FOUNDATION TO EXERCISE ITS POWERS WITHIN THE <br />TERRITORIAL BOUNDARIES OF THE CITY OF SAN MARCOS, <br />TEXAS; AUTHORIZING A COOPERATION AGREEMENT; AND <br />DECLARING AN EFFCTIVE DATE. <br />RECITALS: <br />WHEREAS, there exists in the City of San Marcos, Texas a shortage of safe and sanitary <br />housing available to lower income residents at rents they can afford; <br />WHEREAS, the Texas Housing Foundation, a Texas regional housing authority ( "THF "), <br />has significant experience in providing, developing, financing and managing housing projects <br />that are affordable to lower income residents and are assets to the community; <br />WHEREAS, the THE proposes to enter into the General Partner role in the Jackson <br />Community Apartments, L.P., a Texas Limited Partnership, which owns the 64 multi- family <br />housing units known as Asbury Place Apartments located at 1400 Wonder World Drive in San <br />Marcos, Texas and THE would operate this now - existing multi - family rental housing project for <br />low - income citizens in the City of San Marcos, Texas; <br />WHEREAS, Texas Local Government Code, Section 392.017(d) requires that the <br />governing body of a municipality and any housing authority authorized to exercise its powers <br />exclusively in the municipality adopt a resolution declaring a need for a regional housing <br />authority to exercise its powers within their jurisdiction, and authorizing a cooperation <br />agreement under Texas Local Government Code Section 392.059; <br />WHEREAS, the City Council of San Marcos, Texas is the governing body of the City of <br />San Marcos, Texas and the Housing Authority of the City of San Marcos is authorized to <br />exercise its powers exclusively in the City of San Marcos, Texas; <br />WHEREAS, Texas Local Government Code, Section 392.017(d) requires the City <br />Council of San Marcos, as the governing body of San Marcos, and the Housing Authority for the <br />City of San Marcos to adopt a resolution declaring a need for a regional housing authority to <br />exercise its powers in the municipality in the planning, development, construction, financing, <br />and operation of the housing project described herein for lower income citizens; and <br />WHEREAS, Texas Local Government Code, Section 392.017(d) requires that the <br />governing body of the municipality of San Marcos, Texas and the Housing Authority for the City <br />of San Marcos, adopt a resolution authorizing a cooperation agreement under Texas Local <br />Government Code, Section 392.059 for the THE to operate within the area of operation of the <br />Housing Authority of the City of San Marcos. <br />
