RESOLUTION NO.2026-29R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING A STANDARD UTILITY AGREEMENT <br />SUPPLEMENTAL AND AN ADVANCED FUNDING AGREEMENT <br />AMENDMENT WITH THE STATE OF TEXAS, ACTING THROUGH THE <br />TEXAS DEPARTMENT OF TRANSPORTATION, TO PROVIDE <br />REIMBURSEMENT TO THE CITY FOR INCREASED UTILITY <br />REMOVAL AND RELOCATION COSTS, RELATING TO THE PROJECT <br />ALONG INTERSTATE HIGHWAY 35 AT STATE HIGHWAY 123, FROM <br />SOUTH OF STATE HIGHWAY 80 TO NORTH OF RANCH TO MARKET <br />12, IN THE AMOUNT OF $346,211.95; AUTHORIZING THE CITY <br />MANAGER, OR HER DESIGNEE, TO EXECUTE THE APPROPRIATE <br />DOCUMENTS ON BEHALF OF THE CITY; AND DECLARING AN <br />EFFECTIVE DATE. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The attached Standard Utility Agreement Supplemental No. 1, to the <br />Contract No. 0016-03-114, and the Advanced Funding Agreement Amendment No. 2, with the <br />State of Texas, acting through the Texas Department of Transportation (the "Agreement") is <br />approved. <br />PART 2. The City Manager, or her designee, is authorized to execute the Agreement <br />on behalf of the city. <br />PART 3.
