<br />223. <br /> <br />RESOLUTION NO. 2003 - -11lLR <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS APPROVING A LICENSE AGREEMENT <br />BETWEEN THE CITY AND FAIRFIELD SAN MARCOS <br />EXCHANGE, LTD. FOR THE CONSTRUCTION AND <br />MAINTENANCE OF SIDEWALK AND BUS BENCH <br />IMPROVEMENTS IN THE UHLAND ROAD RIGHT-OF-WAY; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AGREEMENT; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. Fairfield San Marcos Exchange Ltd., the owner of the property at 1610 IH-35 North, has <br />requested pennission to construct and maintain sidewalk and bus bench improvements in an area of <br />the right-of-way ofthe 1800 Block of Uhland Road adjacent to its property. <br /> <br />2. The City is willing to grant permission for this construction and maintenance in <br />accordance with the terms and conditions of the attached License Agreement. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The attached License Agreement between the City and Fairfield San Marcos <br />Exchange Ltd. is approved. <br /> <br />PART 2. The City Manager, Dan O'Leary, is authorized to execute the attached agreement <br />on behalf of the City. <br /> <br />PART 3.
