RESOLUTION NO. 2026-67R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING AN ADVANCED FUNDING <br /> AGREEMENT (AFA) (CJS NO. 0914-33-117) WITH THE STATE OF <br /> TEXAS, ACTING THROUGH THE TEXAS DEPARTMENT OF <br /> TRANSPORTATION (TXDOT), FOR A TRANSPORTATION <br /> ALTERNATIVES SET-ASIDE (TASA) PROJECT FOR THE CAPE <br /> STREET RECONSTRUCTION AND SHARED USE PATH (SUP) <br /> PROJECT;AUTHORIZING THE CITY MANAGER,OR HER DESIGNEE, <br /> TO EXECUTE SAID AGREEMENT; AND DECLARING AN EFFECTIVE <br /> DATE. <br /> WHEREAS, on October 26, 2025, via Minute Order 116575, the Texas Transportation <br /> Commission authorized the Cape Street Reconstruction and Shared Use Path (SUP) project (the <br /> "Project) to receive Transportation Alternatives Set-Aside (TASA) funds for project construction <br /> and Texas Department of Transportation (TxDOT or the State) oversight; and <br /> WHEREAS, the TASA funds require a local match, the City of San Marcos commits to <br /> provide the match. The local match is comprised of Transportation Development Credits (TDCs) <br /> in the estimated amount of$468,600.00; and <br /> WHEREAS, the City of San Marcos is responsible for all non-reimbursable costs and <br /> 100%of overruns, if any; and <br /> WHEREAS, the City Council of the City of San Marcos desires to reaffirm its support of <br /> the Project and approve and authorize the execution of an Advance Funding Agreement (AFA) <br /> with TxDOT for the Project;NOW THEREFORE, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The attached Advance Funding Agreement(AFA) (CSJ No. 0914-33-117), <br /> with the Texas Department of Transportation("the Agreement") for a Transportation Alternatives <br /> Set-Aside (TASA)project for the Cape Street Reconstruction and Shared Use Path (SUP)project <br /> the "Project") is hereby approved. <br /> PART 2. The City Manager, or her designee, is authorized to execute the Agreement <br /> on behalf of the city. <br /> PART 3. This resolution shall be in full force and effect immediately from and after <br /> its passage. <br />
