<br />A~1 Ô:RDINANCE OF THE CITY COUNCI L OF THE CITY OF SAN
<br />MARCOS, TEXAS, ~1ENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED ~JNE 13, 1984 (VOL. 66) BY
<br />ZONING BLOCK 6, LOT 315 OUT OF THE WESTOVER ADDITION TO
<br />THE CITY OF SAN MARCOS, AS RECORDED IN VOLUME 59, PAGES
<br />184-185 OF THE HAYS COUNTY DEED RECORDS; A/K/A 1300
<br />BISHOP STREET FROH "R-l" (SINGLE FAMI LY m'ifELLING DISTRICT-
<br />LO~J DENSITY) TO "DP-l" (DUPLEX DISTRICT-LOW DENSITY); AND
<br />DECLARING AN EFFECTIVE DATE.

<br />WHEREAS, on November 18,1986, the Planning and Zoning Commissions
<br />of the City of San Marcos held a public hearing regarding a request to
<br />change the zoning from "R-1" (Single Family Dwelling District-Low
<br />Density) to "DP-1" (Duplex District-Low Density) of Block 6, Lot
<br />315 out of the ~~stover Addition, San Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS, &ubsequent to said public hearing on said date, said
<br />Zoning Commission did, on November 18, 1986, consider said request
<br />and voted to approve the same and has recommended that such request
<br />be approved by the City Council of said City; and,
<br />

<br />WHEREAS, said City Council held a public hearing on the 13
<br />April, ,1987, regarding such request; and,
<br />
<br />day

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />SAN
<br />
<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />"R-l" (Single Family Dwelling District-Low Density) be rezoned "DP-l"
<br />(Duplex District-Low Density), on the condition that vehicular access to
<br />said property be limi t~d to access from Delmar Street only.
<br />
<br />BLOCK 6, LOT 315 OUT OF THE WESTOVER ADDITION TO THE CITY OF
<br />SAN MARCOS, AS RECORDED IN VOLUME 59, PAGES 184-185 OF THE HAYS
<br />COUNTY DEED RECORDS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on April 27, 1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this
<br />subject to reconsideration at the next
<br />scheduled for April 27, 1987
