RESOLUTION NO. 2026-121R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING A CHANGE IN SERVICE TO THE <br /> AGREEMENT WITH BURNS & MCDONNELL ENGINEERING <br /> COMPANY, INC. AUTHORIZING THE NEXT PHASE OF DESIGN- <br /> BUILD SERVICES FOR THE FM 1978 WATER RECLAMATION <br /> FACILITY PROJECT IN THE ESTIMATED AMOUNT OF$42,000,000.00; <br /> AUTHORIZING THE CITY MANAGER, OR HER DESIGNEE, TO <br /> EXECUTE THE CHANGE IN SERVICE AND TO FINALIZE ANY NON- <br /> MATERIAL REVISIONS AFTER COUNCIL APPROVAL ON BEHALF OF <br /> THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. A Change In Service to the agreement with Burns & McDonnell <br /> Engineering Company, Inc. (Contract No. 2025-087)to provide progressive design-build services <br /> for the FM 1978 Water Reclamation Facility project in the estimated amount of$42,000,000.00 is <br /> approved. <br /> PART 2. The City Manager,or her designee,is hereby authorized to execute any non- <br /> material revisions needed to finalize the Change in Service after Council approval, provided it <br /> does not alter the city's rights, obligations, or financial commitments, on behalf of the city. <br /> PART 3.
