<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, CANVASSING RETURNS AND
<br />DECLARING RESULTS OF THE JOINT CITY AND COUNTY
<br />SPECIAL ELECTION HELD ON AUGUST 8, 1987 FOR
<br />THE PURPOSE OF CONSIDERING THE ADOPTION OF AN
<br />ADDITIONAL ONE-HALF OF ONE PERCENT (1/2%)
<br />LOCAL SALES AND USE TAX WITHIN THE CITY TO
<br />REDUCE THE PROPERTY TAX RATE, AND SAID JOINT
<br />SPECIAL ELECTION TO BE HELD WITHIN AND WITHOUT
<br />THE CORPORATE LIMITS OF SAID CITY FOR THE
<br />PURPOSE OF CONSIDERING THE ADOPTION OF AN
<br />ADDITIONAL ONE-HALF OF ONE PERCENT (1/2%)
<br />LOCAL SALES AND USE TAX WITHIN THE COUNTY TO
<br />REDUCE THE PROPERTY TAX RATE, AND DECLARING AN
<br />EMERGENCY.

<br />
<br />WHEREAS, the City Council of the City of San Marcos, Texas,
<br />by ordinance adopted on July 13, 1987, ordered that a joint City
<br />and County special election be held on August 8, 1987 for the
<br />purpose of considering the adoption of an additional one-half of
<br />one percent (1/2%) local sales and use tax within the City to
<br />reduce the property tax rate, and said Joint Special Election to
<br />be held within and without the corporate limits of said City for
<br />the purpose of considering the adoption of an additional one-half
<br />of one percent (1/2%) local sales and use tax within the County to
<br />reduce the property tax rate: and,
<br />
<br />WHEREAS, notice of said election was duly publ ished in the
<br />San Marcos Daily Record on July 17 and 24, 1987; and,
<br />
<br />WHEREAS, copies of said notice were duly posted at each city
<br />election precinct polling place prior to said election, and a copy
<br />of same was posted on the bulletin board at City Hall on or before
<br />July 17, 1987: and,
<br />
<br />WHEREAS, said election was duly and legally held on the 8th
<br />day of August, 1987, in conformity with the election laws of the
<br />State of Texas, and the results of said election have been
<br />certified and returned by the proper judges and clerks thereof;
<br />and,
<br />
<br />WHEREAS, the City Council of the City of San Marcos, Texas,
<br />with the following members present: Karl Brown, J. E. Younqer,
<br />Rick Hernandez, Betty Jane Kissler, William C. Nicola.
<br />has today considered the returns of said joint special election
<br />held on the 8th day of August, 1987: and,
<br />
<br />WHEREAS, it appears to the Council, and the Council so finds,
<br />that the said election was in all respects lawfully held; and,
<br />
<br />WHEREAS, it appears to the Council, and the Council so finds,
<br />that the tabulation of the results of said election is correct:
<br />now, therefore,
<br />
<br />BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
<br />SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That the joint City and County special
<br />election of August 8, 1987 was duly called, that notice of said
<br />election was given in accordance with law, and that said election
<br />was held in accordance with law.
<br />
<br />SECTION 2. That the tabulation of votes cast in the joint
<br />City and County special election held on August 8, 1987 for the
<br />purpose of considering the adoption of an additional one-half of
<br />one percent (1/2%) local sales and use tax wi thin the City to
<br />reduce the property tax rate, made and certified to by the City
<br />Secretary of the City of San Marcos, a copy of which is attached
<br />hereto and made a part hereof, be, and the same is hereby, adopted
<br />as the official tabulation of the votes cast at said election and
<br />that said tabulation be filed and recorded in the official records
<br />
