<br />238 <br /> <br />RESOLUTION 1987-109R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, TERMINATING THAT AGREEMENT WITH THE SAN <br />MARCOS CHAMBER OF COMMERCE WHICH IS SCHEDULED TO END ON <br />DECEMBER 30, 1987, AND WHICH PROVIDES FOR THE USE OF <br />THE PROCEEDS OF THE HOTEL/MOTEL TAX, APPROVING A LETTER <br />OF TERMINATION TO BE ISSUED BY THE CITY MANAGER AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, wishes <br />to have the contract with the Chamber of Commerce pertaining to the use <br />of hotel/motel tax funds be in effect from October 1 of each fiscal <br />year until the September 30 end of each fiscal year; and, <br /> <br />WHEREAS, the City Council is required by Section VI of the <br />agreement with the Chamber of Commerce to provide a formal written <br />notice of termination of the existing agreement so that the effective <br />dates of the agreement can be realigned; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY <br />TEXAS: <br /> <br />COUNCI L OF <br /> <br />THE <br /> <br />CITY OF <br /> <br />SAN <br /> <br />MARCOS, <br /> <br />PART 1. That the agreement between the City of San Marcos and the <br />San Marcos Chamber of Commerce pertaining to the use of proceeds from <br />the hotel/motel tax for the promotion of tourism in the City of San <br />Marcos be terminated effective at midnight on September 30,1987. <br /> <br />PART 2. That the notice of termination be issued by the City <br />Manager as provided in that letter from the City Manager to the <br />president of the San Marcos Chamber of Commerce, a copy of which is <br />attached hereto and incorporated herein for all purposes. <br /> <br />PART 3. That the City Manager and the City Attorney be directed <br />to work with the Chamber of Commerce to negotiate a new agreement. with <br />the Chamber of Commerce for the use of proceeds from the <br />hotel/motel tax for the promotion of tourism in the City and that said <br />agreement be prepared and presented to the City Council at its <br />regular meeting on September 28,1987. <br /> <br />PART 4.
