<br />A RESOLUTION OF THE CITY COUNCIL OF THE
<br />CITY OF SAN MARCOS, TEXAS, ACKNOWLEDGING,
<br />APPROVING AND RATIFYING TWO PRIOR RATE
<br />INCREASES TO THE AGREEMENT WITH
<br />BRO\vNING-FERRIS, INC. , APPROVING THE
<br />AMENDMENT TO THE AGREEMENT WITH
<br />BROWNING-FERRIS, INC. TO INCREASE TH1~
<br />BASE RESIDENTIAL RATE, AUTHORIZING THE
<br />MAYOR TO EXECUTE SAID ADDENDUM, AND
<br />DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, the City of San Marcos entered into an
<br />agreement with Browing-Ferris, Inc. on April 11, 1983 for
<br />solid waste collection and disposal and such work as may be
<br />incidental thereto; and,
<br />
<br />WHEREAS, said agreement provides for the modification of
<br />rates to reflect changes in the cost of operations as
<br />reflected by fluctuations in the Consumer Price Index; and,
<br />
<br />WHEREAS, pursuant to said agreement, the base
<br />residential rate of said agreement has been increased on two
<br />prior occasions, on September 1, 1984, in the amount of $.12,
<br />and on August 1, 1985, in the amount of $.18, to reflect
<br />fluctuations in the Consumer Price Index, bringing the
<br />present base residential rate of said agreement to Four
<br />Dollars and Ninety-Seven Cents ($4.97) per unit; and,
<br />
<br />WHEREAS, said agreement also provides for unit price
<br />adjustments on the basis of additional duties and
<br />responsibili ties imposed upon Browning-Ferris, Inc. by
<br />changes or addi tions to laws, ordinances, rules or
<br />regulations, or new laws, ordinances, rules or regulations;
<br />and,
<br />
<br />WHEREAS, fluctuations in the Consumer Price Index
<br />warrant a fee increase of $ .04 in the base residential rate
<br />of said agreement; and,
<br />
<br />WHEREAS, increased governmental regulations have imposed
<br />additional duties and responsibilities upon Browning-Ferris,
<br />Inc. in the performance of said agreement and warrant an
<br />increase of $.39 in the Base Residential Rate of said
<br />agreement; now, therefore,
<br />
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS:
<br />
<br />PART 1. That the two prior increases in the base
<br />residential rate of said agreement on September 1, 1984, in
<br />the amount of $.12, and on August 1, 1985, in the amount of
<br />$.18, be and are hereby acknowledged, approved and ratified,
<br />bringing the present total base residential rate of said
<br />agreement to $4.97.
<br />
<br />PART 2. That the amendment to the agreement between
<br />City of San Marcos and Browning-Ferris, Inc. to increase the
<br />Base Residential Rate of the agreement $.43 is hereby
<br />approved.
<br />
<br />PART 3. That the Mayor, J. E. Younger, be, and he is
<br />hereby authorized to execute said addendum to said agreement
<br />of behalf of City of San Marcos.
<br />
<br />PART 4. That this Resolution shall be in
<br />and effect from and after its passage.
