ORDINANCE NO. 2003- 73 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING A REVISED SCHEDULE OF WHOLESALE WATER TREATMENT RATES AND TERMS AND CONDITIONS TO INCREASE THE CITY'S WHOLESALE WATER TREATMENT RATE; AND INCLUDING PROCEDURAL PROVISIONS. RECITALS: t~ 1.The City owns and operates the San Marcos Water Treatment Plant (the "Plant"), which presently has treatment capacity in excess of the City's needs, and the excess treatment capacity is available for use by other water service providers. 2. The City Council, in Ordinance No. 2000-60 adopted on September 11, 2000, established a rate schedule and terms and conditions for the treatment of raw water at the Plant, in accordance with accepted rate-making practices, and in accordance with the City's agreement with the Guadalupe-Blanco River Authority dated July 1, 1997, as amended, for the development of a regional surface water supply project. 3. The City Council wishes to revise the rate schedule and terms and conditions for the treatment of raw water at the Plant, to increase the wholesale water treatment rate from $1.06/1,000 gallons to $1.22/1,000 gallons, in accordance with the recent recommendation of the City's consultant on water and wastewater rates. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Schedule of Wholesale Water Treatment Rates and Terms and Conditions attached to this ordinance is approved. SECTION 2. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 4. This Ordinance will take effect 10 days after the date of its final passage, and the City Clerk will publish notice of its adoption in a newspaper of general circulation in the City.
