ORDINANCE NO. 2003- 73 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS APPROVING A <br />REVISED SCHEDULE OF WHOLESALE WATER <br />TREATMENT RATES AND TERMS AND <br />CONDITIONS TO INCREASE THE CITY'S <br />WHOLESALE WATER TREATMENT RATE; AND <br />INCLUDING PROCEDURAL PROVISIONS. <br /> <br />RECITALS: <br /> <br />t~ <br /> <br /> 1.The City owns and operates the San Marcos Water Treatment Plant (the "Plant"), which <br />presently has treatment capacity in excess of the City's needs, and the excess treatment capacity is <br />available for use by other water service providers. <br /> <br /> 2. The City Council, in Ordinance No. 2000-60 adopted on September 11, 2000, established <br />a rate schedule and terms and conditions for the treatment of raw water at the Plant, in accordance <br />with accepted rate-making practices, and in accordance with the City's agreement with the <br />Guadalupe-Blanco River Authority dated July 1, 1997, as amended, for the development of a <br />regional surface water supply project. <br /> <br /> 3. The City Council wishes to revise the rate schedule and terms and conditions for the <br />treatment of raw water at the Plant, to increase the wholesale water treatment rate from $1.06/1,000 <br />gallons to $1.22/1,000 gallons, in accordance with the recent recommendation of the City's <br />consultant on water and wastewater rates. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION 1. The Schedule of Wholesale Water Treatment Rates and Terms and Conditions <br />attached to this ordinance is approved. <br /> <br /> SECTION 2. All ordinances and resolutions or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br /> <br /> SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br /> SECTION 4. This Ordinance will take effect 10 days after the date of its final passage, and <br />the City Clerk will publish notice of its adoption in a newspaper of general circulation in the City. <br /> <br />PASSED on first reading on November 10, 2003. <br /> <br /> <br />
