Cavazos Mayor Also Present: Jerri Martin, Alan King, Alvin Langhamer, Terry Roberts, John Dennison, Harry Overstreet, George Jones, Jim Wommack, Gilbert Tenorio, Arturo Espinosa, Gary Bond, Frances Emery, Jeff Ebner, Mary Castillo, and others. Mayor Pro Tempore Bob Hyatt called the meeting to order at 7:30 p.m. The minutes of the regular meeting held Monday, September 11, 1978, were approved on motion of Mr. Sutton and second of Mr. Hansen. The minutes of the special meeting held Wednesday, September 13, 1978, were approved on motion of Mr. Hansen and second of Mr. Breihan. Mr. Hyatt introduced nominations ~or consideration to the Building Code Board of Appeals and the Municipal Court Judge. Mr. Hansen moved Mr. Arturo Espinosa and Mr. George Jones be appointed to the Building Code Board of Appeals. Mr. Breihan seconded the motion which passed unanimously. Mr. Breihan moved to table the Municipal Court Judge vacancy. Mr. Hansen seconded the motion which passed unanimously. Mr. Hyatt opened a public hearing on a request by Entex, Inc. for a rate increase. Mr. Jim Wommack, representing the Community Action Agency, entered a statement objecting to the increase in the minimum residential charge. Saying it would have the greatest impact on persons having low or fixed incomes. Mr. John Dennison, President of Electric Power Engineers, Inc., City Rate Consultant, carne before the Council to agree that the largest percentage increase would go to the lower consumption users. Hr. Dennison pointed out that the industrial and large commercial rate would not be increased and advised the Council against approving the automatic cost of service escalation charge. Mr. Harry Overstreet, Entex District Manager, informed the Council that industrial rates had been increased in 1974 and that those rates needed to be competitive in order for Entex to keep its accounts. Council agreed to continue the hearing at the next regular meeting. Mr. James entered the meeting during the hearing. Therefore, his vote is not reflected in earlier roll calls. Mr. Hyatt read an ordinance in its entirety having the follow- ing caption: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGU- LATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE 20NING OF A .308 ACRE TRACT IN ABSTRACT 17-1, TRACT #24, J. M. VERAMENDI SURVEY #1, (SEE METES AND BOUNDS DESCRIPTION ATTACHED AS EXHIBIT A) LOCATED AT 209 1. H. 35 NORTH, FROM "C" (COMMERCIAL) TO "C- 2" (COMMERCIAL).
