<br />47 <br /> <br />ORDINANCE 1981-37 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, M1ENDING CHAPTER 12, <br />ENTITLED "GARBAGE AND TRASH", OF THE CODE OF <br />ORDINANCES OF SAID CITY TO INCLUDE A NEW SEC- <br />TION REQUIRING A DEPOSIT TO OBTAIN GARBAGE <br />SERVICE FROM SAID CITY WHEN CITY UTILITY SER- <br />VICE IS NOT PROVIDED TO THE SAME SITE AND SET- <br />TING THE AMOUNT OF SAID DEPOSIT FOR DIFFERENT <br />TYPES OF SERVICE AND DECLARING AN EMERGENCY. <br /> <br />WHEREAS, on February 23, 1981, the City Council of the <br />City of San Marcos, Texas, increased ~he amounts required as <br />deposits for utility service to residences and commercial <br />establishments from the City of San Marcos, Texas; and, <br /> <br />WHEREAS, there exists a need to require deposits from <br />persons and/or establishments who receive garbage service, but <br />no utility service, from the City of San Marcos; and, <br /> <br />WHEREAS, said City Council desires that required deposits <br />for city services to be uniform; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the Code of Ordinances, City of San Marcos, <br />Texas, is hereby amended by adding a section, to be numbered 12-19, <br />which said section reads as follows: <br /> <br />Sec. 12-19. Deposit <br /> <br />Subsequent to the effective date of this section, <br />the following amounts shall be paid by persons <br />and/or establishments requesting garbage pickup <br />service from the City of San Harcos, Texas, but <br />which will receive no utility service from said <br />City: <br /> <br />(a) For pickup of garbage at a single- <br />family residence <br /> <br />$35.00 <br /> <br />(b) For pickup of garbage at any other <br />residence <br /> <br />$35.00 or l~ <br />times the <br />monthly bill, <br />whichever amount <br />is greater <br /> <br />(c) For pickup of garbage at commercial <br />establishments <br /> <br />V;-; times the <br />monthly bill <br /> <br />SECTION 2. That the importance of this Ordinance creates <br />an emergency and an imperative purpose necessary that the pro- <br />visions of the charter requiring that ordinances shall be read <br />at three separate meetings and that no ordinance shall become <br />effective until the expiration of ten (10) days following the <br />date of its final passage be suspended, and these provisions are <br />hereby suspended, and this Ordinance shall take effect and be <br />in full force and effect from and after its adoption and publica- <br />tion in a newspaper of general circulation wi thin i:the ci ty. <br /> <br />PASSED, APPROVED, AND ADOPTED this 11th day of May <br /> <br />19 8 1. <br /> <br />~ <br /> <br />Berry R. ..
