Hofheinz, <br />Mrs. Non Douglas Wray, Ronald Terry Dolan, <br />William Scott Dolan, Jack Major, and others <br /> <br />The Mayor a'll led the meeting to arder at 7:30 p.m. <br />The Reverend John Salvador, St. John's Church, gave the Invocation. <br /> <br />The Minutes of the Sept. 14, Sept. 18 and Sept. 23, 1964, <br />meetings were approved as presented. <br /> <br />'1 <br /> <br />First order of business was the hearing of an appeal by the <br />Council, sitting as a Board of Appeals under provision of <br />Section 18 of the Planning and Zoning Ordinance. The following <br />data had been furnished the Council by City Manager-Planner <br />Fu Iler: <br /> <br />"Mrs. W.A. Dolan bought property at 816 West Hopkins Street, <br />zoned as 'R'., Single Fami ly District. In Apri I and May of 1964 <br />Mrs.Dolan attempted to get the zoning changed from 'R' to <br />'M', Multifami Iy. This was refused. The request was then made <br />for a zoning change from 'R' to '0' Duplex. This was refused. <br /> <br />UMrs. Dolan began renovation of the residence and was notified <br />on August 21st that she was in violation of Section 8 A of the <br />Zoning Ordinance. This Section limits occupancy to a single <br />family dwelling. On August 27th, Mrs. Dolan opened a water <br />account "under construction", but gave the Chief Inspector a <br />letter that the property would be occupied as a single fami Iy <br />residence until the matter could be decided. <br /> <br />I <br /> <br />"The City Attorney has ruled that the vacancy was of such dur- <br />ation that it could not be construed as being a continuing use <br />and thereby eligible under Section 17, Nonconforming Uses. The <br />purchaser, Mrs. Dolan, is prepared to testify that she has wit- <br />nesses who attempted to rent the house. However, no renter, <br />either a single family or as a muttifami ly unit, occupied the <br />premises from prior to August, 1958, unti I Mrs. Dolan purchased <br />the property in 1964, a period of almost six (6) years. With the <br />housing shortage which has existed in San Marcos during a portion <br />of this time, it would appear that this property could have been <br />occupied. <br /> <br />- <br />...... <br />....... <br />-- <br />;;.... <br />~ <br />;,." <br /> <br />88l <br />
