The Minutes of the Sept. 14, Sept. 18 and Sept. 23, 1964, meetings were approved as presented. '1 First order of business was the hearing of an appeal by the Council, sitting as a Board of Appeals under provision of Section 18 of the Planning and Zoning Ordinance. The following data had been furnished the Council by City Manager-Planner Fu Iler: "Mrs. W.A. Dolan bought property at 816 West Hopkins Street, zoned as 'R'., Single Fami ly District. In Apri I and May of 1964 Mrs.Dolan attempted to get the zoning changed from 'R' to 'M', Multifami Iy. This was refused. The request was then made for a zoning change from 'R' to '0' Duplex. This was refused. UMrs. Dolan began renovation of the residence and was notified on August 21st that she was in violation of Section 8 A of the Zoning Ordinance. This Section limits occupancy to a single family dwelling. On August 27th, Mrs. Dolan opened a water account "under construction", but gave the Chief Inspector a letter that the property would be occupied as a single fami Iy residence until the matter could be decided. I "The City Attorney has ruled that the vacancy was of such dur- ation that it could not be construed as being a continuing use and thereby eligible under Section 17, Nonconforming Uses. The purchaser, Mrs. Dolan, is prepared to testify that she has wit- nesses who attempted to rent the house. However, no renter, either a single family or as a muttifami ly unit, occupied the premises from prior to August, 1958, unti I Mrs. Dolan purchased the property in 1964, a period of almost six (6) years. With the housing shortage which has existed in San Marcos during a portion of this time, it would appear that this property could have been occupied. - ...... ....... -- ;;.... ~ ;,." 88l
