79. <br /> <br />RESOLUTION 2004- 63 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, RESCINDING APPROVAL OF A CONTRACT EXTENSION WITH <br />DELTA-Y ELECTRIC COMPANY FOR THE PURCHASE OF SINGLE <br />PHASE PAD MOUNTED TRANSFORMERS FOR THE ELECTRIC UTILITY <br />DEPARTMENT; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br /> 1. On February 9, 2004, the City Council approved a one year contract <br />extension with Delta-Y Electric (the "Contractor") Company for the purchase of single <br />phase pad mounted transformers for the Electric Utility Department. <br /> <br /> 2. On February 19, 2004 the Contractor transmitted correspondence t° the City <br />indicating that it could not honor its original contract due to escalating prices of components <br />parts and oil used for transformer manufacturing. <br /> <br />3. The City wishes to rescind its approval of the contract extension. <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> PART 1. The approval of a contract extension with Delta-Y Electric Company, <br />Inc. for the purchase of single phase pad mounted transformers is rescinded. <br /> <br /> PART 2. The Purchasing Manager, Cheryl P antermuehl, is authorized and <br />directed to provide notice of this rescission of the contract to the Contractor. <br /> <br /> PART 3. <br />after its passage. <br /> <br />This Resolution shall be in full force and effect immediately from and <br /> <br />ADOPTED thisthe 12th dayof .~p~:±l 2004. <br /> <br />Attest: <br /> <br />J~nis K.
