<br />52 <br /> <br />ORDINANCE NO. 40a <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, APPROVING THE PRICE AND <br />CONDITIONS OF THE SALE BY THE CITY OF SAN MARCOS, <br />TEXAS, OF 25,450 SQUARE FEET OF LAND AREA OUT <br />OF THE J. M.. VERAMENDI SURVEY NO. ONE (FURTHER <br />DESCRIBED BY METES AND BOUNDS IN THE ATTACHED <br />EXHIBIT A, ALSO KNOWN AS URBAN RENEWAL PARCEL <br />12-2 LOCATED WITHIN THE TEX. A-6 NEIGHBORHOOD <br />DEVELOPMENT PROGRAM AREA, TO TED COHEN; <br />AUTHORIZING THE MAYOR TO EXECUTE A WARRANTY <br />DEED TO TED COHEN; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, the City of San Marcos, Texas, advertised for bids for the <br />sale of that certain real property known as 25,450 square feet out <br />of the J.M. Veramendi Survey No. One, also known as Urban Renewal <br />Parcel No. l2-2, located within the Tex~ A-6, Neighborhood <br />Development Program area, in the San ~1arcos Record, a local newspaper <br />with a general circulation in the County of Hays, State of Texas; <br />and, <br /> <br />WHEREAS, pursuant to said advertisement a bid was submitted by Ted <br />Cohen for said property; and <br /> <br />WHEREAS, the said bid met the minimum disposition price set upon <br />said property by the Board of Commissioners of the Urban Renewal <br />Agency of the Cityof San Marcos, Texas; and, <br /> <br />WHEREAS, the said Board accepted the bid as the highest and best <br />responsible bid for said property by a motion duly passed on <br />August 14, 1979, after the bid opening of August 14, 1979; and, <br /> <br />I <br /> <br />WHEREAS, said motion also approved the terms and conditions for the <br />sale of the said property and recommended the approval of said <br />purchase price and the approval of the terms and conditions for the <br />sale, as contained in the bid documents, by the City Council of <br />the City of San Marcos, Texas; and, <br /> <br />WHEREAS, the aforementioned bid and proposed use set forth in said <br />bid and the sales terms and conditions pertinent thereto conform to <br />the Redevelopment Plan for ~he development of the City as a whole; <br />and, now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Section 1. That.the terms and conditions of the sale by the City <br />of San Marcos, Texas, of 25,450 square feet out of the J.M. Veramendi <br />Survey No. One, further described by metes and bounds in the attached <br />Exhibit A, also known as Urban Renewal Parcel No. 12-2, to Ted Cohen, <br />are hereby approved. <br /> <br />Section 2. That the consideration for the sale for said property <br />being $40,680 for 25,450 square feet is hereby approved. <br /> <br />I <br /> <br />Section 3. That the sale by the City of San Marcos is made subject <br />to restrictions of the Redevelopment Plan for the Tex. A-6 Neighborhood <br />Development Program, as approved and amended and is on file and <br />available for inspection in the Office of the Director of Community <br />Development of theCity of San Marcos. <br /> <br />Section 4. That the conditions of the disposition documents, including <br />the Deed and Contract for Sale for Private Redevelopment, are on file <br />and are available for inspection in the Office of the Director of <br />Community Development of the City of San Marcos. <br /> <br />Section 5. That the purchaser is hereby placed on notice that the <br />subject property is subject to assessment under the provisions of <br />Article 1105b of the Revised Civil Statutes of the State of Texas. <br />
