<br />I <br /> <br />I <br /> <br />I <br /> <br />11 <br /> <br />RESOLUTION 00. 197B-37-R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, TEXAS, <br />AUTHORIZING ACCEPTANCE FOR CONSTRUCTION <br />OF UTILITIES ON BARNES DRIVE IN <br />SAN MARCOS, TEXAS; AUTHORIZING FINAL <br />PAYMENT FOR THIS CONSTRUCTION, AND <br />ESTABLISHING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City af San Marcos, Texas, has contracted with <br />Du-Mor Enterprises, for the construction of utilities on <br />Barnes Drive, San Marcos, Hays County, Texas; and, <br /> <br />WHEREAS, the construction of utilities on Barnes Drive <br />was completed on March 24, 1978; and <br /> <br />WHEREAS, the Director of Public Works and the Community <br />Development Department and the Cammunity Development Inspector <br />inspected the construction of utilities on Barnes Drive On <br />March 24, 1978 and determined that the contractual provisions <br />for construction of said utilities on Barnes Drive had been <br />met by Du-Mor Enterprises on that date; and, <br /> <br />WHEREAS, the Director of Public Works of the City af San Marcos <br />recommends that the City Council accept the construction of <br />utilities on Barnes Drive far use by the City effective on the <br />24th day of March, and authorize final payment to Du-Mor <br />Enterprises in the amount of eighteen thousand, eight hundred <br />twenty-eight dollars and fifty cents ($lB,82B.50); and, <br /> <br />WHEREAS, Du-Mor Enterprises requests final payment for the com- <br />pletion of the utilities an Barnes Drive; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the work performed by Du-Mor Enterprises in <br />construction of utilities on Barnes Drive, be, and is hereby, <br />accepted as being complete effective on the 24th day of March <br />A. D., 197B, pursuant to the terms of the contract for said <br />construction. <br /> <br />SECTION 2. That the City of San Marcos is hereby authorized <br />to make the final payment to Du-Mor Enterprises for said <br />construction in the amount of eighteen thousand, eight hundred <br />twenty-eight dollars and fifty cents ($18,828.50). <br /> <br />SECTION 3.
