<br />141 <br /> <br />ORDINANCE NO. 1978-25 <br /> <br />I <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, VACATING AND ABANDONING <br />AN ALLEY IN BLOCK THREE OF THE ORIGINAL TOWN <br />OF SAN MARCOS, SAID ALLEY BEING PARALLEL TO <br />MOON AND WATER STREETS AND BETWEEN HOPKINS <br />AND HUTCHISON STREETS; AND DECLARING AN EMER- <br />GENCY. <br /> <br />I <br /> <br />I <br />WHEREAS, the map or plat of Block Three (3) of the, Original Town <br />of San Marcos, Texas, reflects an alley as located'between Hopkins <br />and Hutchison Streets and running parallel to both'Moon and Wat:er <br />Streets; and, <br /> <br />WHEREAS, neither said map or plat, of record in Vo;Lume 46, page 448, <br />Hays County Deed Records, nor any other instrument' of record in the <br />offices of the Hays County Clerk or the Secretary of the City of <br />San Marcos, declares that said alley was dedicated to the use of the <br />public; and, <br /> <br />WHEREAS, there is not indicated on said plat, nor anywhere elsEl to <br />the knowledge of this Dody, that the City of San Marcos or the County <br />of Hays ever accepted responsibility for the improvement or mainte- <br />nance of said alley, nor has either of said governmental entities <br />improved or maintained said alley at any time to the knowledge of <br />this body; and, <br /> <br />WHEREAS, the abandonment and vacation of said alley will promote the <br />highest and best use of said Block No. Three (3) consistent wi1:h the Ci <br />Zoning Ordinance, Comprehensive Plan, and the Urban Renewal Plan for <br />Project Tex. A-6; now, therefore, <br /> <br />I <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, ~~EXAS: <br /> <br />Section 1. That the alley located in Block Three ,of the Original Town <br />of San Marcos between Hopkins and Hutchison Streets and runninq paralIc <br />to both Moon and Water Streets, be, and it is hereby, abandoned, vacat, <br />discontinued and closed as a public alley in the City of San Marcos, <br />Texas. <br /> <br />Section 2. That the fee to the land in the above described alley is <br />hereby released and shall revert to the adjacent property owner, the <br />City of San Marcos. <br /> <br />Section 3. Because of the committment made to the Chamber of Commerce <br />of a portion of Block Three of the Original Town of San Marcos as a <br />building site and the Chamber's need to commence construction immediate <br />an emergency is declared and the provisions of the Charter req"Lliring <br />that ordinances shall be read on three separate occasions, and that no <br />ordinance shall become final and effective until the expiration of ten <br />(10) days following the date of its final passage is hereby dispensed <br />with, this Ordinance to become effective immediately from and after it, <br />passage by this Council. <br /> <br />PASSED, APPROVED AND ADOPTED <br /> <br />May 1, 1978. <br /> <br />~4Jl (l~~ <br /> <br />Robert L.
