I I I 18 ORDINANCE NO. 1978-36 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE PRICE AND CONDITIONS OF THE SALE BY THE CITY OF SAN MARCOS, TEXAS, OF LOT 18, BLOCK 12, OF THE C. D. WALLACE ADDITI.0N, LOCATED WITHIN THE TEX. A-6 NEIGHBORHOOD DEVELOPMENT PROGRAM AREA, TO JESUS AND LINA MENDOZA; AUTHORIZING THE MAYOR TO EXECUTE A SPECIAL WARRANTY DEED TO JESUS AND LINA MENDOZA; AND DECLARING AN EMERGENCY. WHEREAS, the City of San Marcos, Texas, advertised for bids for the sale of that certain real property known as Lot 18, Block 12 of the C. D. Wallace Addition located within the Tex. A-6 NeighbOI'hood Development Program area in the San Marcos Record, a local newspaper with a general circula- tion in the County of Hays, State of Texas; and, WHEREAS, pursuant to said advertisement, a bid was subn,i tted by Jesus and Lina Mendoza for said Lot 18, Block 12 of the' C. D. Wallace Addition; and, WHEREAS, the said bid met the mlnlmum disposition price set upon said property by the Board of Commissioners of the Urban Renewal Agency of the City of San Marcos, Texas; and, WHEREAS, the said Board accepted the bid as the highest and best responsible bid for said property by a motion duly passed on July 11, 1978, after the bid opening of July 11, 1978; and, WHEREAS, said motion also approved the terms and conditions for the sale of the said property and recommended the approval of said purchase price and the approval of the terms and conditions for the sale, as contained in the bid documents, by the City Council of the City of San Marcos, Texas; and, WHEREAS, the aforementioned bid and proposed use set forth in said bid and the sales terms and conditions pertinent thereto conform to the redevelopment plan for the development of the City as a whole; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: Section 1: That the terms and conditions of the sale by the City of San Marcos, Texas, of Lot 18, Block 12 of the C. D. Wallace Addition to Jesus and Lina Mendoza are hereby approved. Section 2: That the consideration for the sale for said property, being $2,500 for 7.500 square feet is hereby approved. Section 3: That the sale by the City of San Marcos is made subject to restrictions of the redevelopment plan for the Tex. A-6 Neighbor-hood Development Program, as approved and amended. Said plan is on file and is available for inspection in the office of the secretary to the Urban Renewal Agency of the City of San Marcos. Section 4: That the conditions of the disposition documents, including the deed and contract for sale for private redevelop- ment, are on file and are available for inspection in the office of the secretary to the Ur'ban Renewal Agency of the City of San Marcos. Section 5: That the purchaser is hereby placed on notice that the subject property is subject to assessments under the provisions of Article 1105b of the Revised Civil Statutes of the State of Texas.
