<br />I <br /> <br />I <br /> <br />I <br /> <br />18 <br /> <br />ORDINANCE NO. 1978-36 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, APPROVING THE <br />PRICE AND CONDITIONS OF THE SALE BY THE <br />CITY OF SAN MARCOS, TEXAS, OF LOT 18, <br />BLOCK 12, OF THE C. D. WALLACE ADDITI.0N, <br />LOCATED WITHIN THE TEX. A-6 NEIGHBORHOOD <br />DEVELOPMENT PROGRAM AREA, TO JESUS AND <br />LINA MENDOZA; AUTHORIZING THE MAYOR TO <br />EXECUTE A SPECIAL WARRANTY DEED TO JESUS <br />AND LINA MENDOZA; AND DECLARING AN EMERGENCY. <br /> <br />WHEREAS, the City of San Marcos, Texas, advertised for bids <br />for the sale of that certain real property known as Lot 18, <br />Block 12 of the C. D. Wallace Addition located within the <br />Tex. A-6 NeighbOI'hood Development Program area in the <br />San Marcos Record, a local newspaper with a general circula- <br />tion in the County of Hays, State of Texas; and, <br /> <br />WHEREAS, pursuant to said advertisement, a bid was subn,i tted <br />by Jesus and Lina Mendoza for said Lot 18, Block 12 of the' <br />C. D. Wallace Addition; and, <br /> <br />WHEREAS, the said bid met the mlnlmum disposition price set <br />upon said property by the Board of Commissioners of the Urban <br />Renewal Agency of the City of San Marcos, Texas; and, <br /> <br />WHEREAS, the said Board accepted the bid as the highest and <br />best responsible bid for said property by a motion duly passed <br />on July 11, 1978, after the bid opening of July 11, 1978; and, <br /> <br />WHEREAS, said motion also approved the terms and conditions for <br />the sale of the said property and recommended the approval of <br />said purchase price and the approval of the terms and conditions <br />for the sale, as contained in the bid documents, by the City <br />Council of the City of San Marcos, Texas; and, <br /> <br />WHEREAS, the aforementioned bid and proposed use set forth in <br />said bid and the sales terms and conditions pertinent thereto <br />conform to the redevelopment plan for the development of the <br />City as a whole; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />Section 1: That the terms and conditions of the sale by the <br />City of San Marcos, Texas, of Lot 18, Block 12 of the C. D. <br />Wallace Addition to Jesus and Lina Mendoza are hereby approved. <br /> <br />Section 2: That the consideration for the sale for said property, <br />being $2,500 for 7.500 square feet is hereby approved. <br /> <br />Section 3: That the sale by the City of San Marcos is made <br />subject to restrictions of the redevelopment plan for the Tex. <br />A-6 Neighbor-hood Development Program, as approved and amended. <br />Said plan is on file and is available for inspection in the <br />office of the secretary to the Urban Renewal Agency of the City <br />of San Marcos. <br /> <br />Section 4: That the conditions of the disposition documents, <br />including the deed and contract for sale for private redevelop- <br />ment, are on file and are available for inspection in the office <br />of the secretary to the Ur'ban Renewal Agency of the City of <br />San Marcos. <br /> <br />Section 5: That the purchaser is hereby placed on notice that <br />the subject property is subject to assessments under the <br />provisions of Article 1105b of the Revised Civil Statutes of <br />the State of Texas. <br />
