140. <br /> <br />RESOLUTION NO. 2004- 81 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING A LICENSE AGREEMENT <br />BETWEEN THE CITY AND THE ESTATE OF W.C. WILLIAMS FOR <br />THE USE OF A PORTION OF AN ALLEY BEHIND THE PROPERTY <br />AT 127 E. HOPKINS STREET; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE THE AGREEMENT; AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br /> 1. The Estate of W.C. Williams is the owner of the building at 127 E. Hopkins Street, the <br />location of the Dillinger's business downtown. Mr. Ed Tarbutton, on behalf of the estate, has <br />requested permission to use a portion of the alley at the rear of the building for construction of a <br />stairway, and maintenance of a portion of an existing building that encroaches into the alley. <br /> <br /> 2. The City is willing to grant permission for construction of the stairway and maintenance of <br />the encroaching building in accordance with the terms of the attached License Agreement. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br /> PART 1. The attached License Agreement between the City and the Estate ofW. C. <br />Williams is approved. <br /> <br /> PART 2. <br />of the City. <br /> <br />The City Manager is authorized to execute the License Agreement on behalf <br /> <br />PART 3.
