<br />I <br /> <br />I <br /> <br />I <br /> <br />125 <br /> <br />ORDINANCE NO. 1977 - 31 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS APPROVING THE <br />PRICE AND TERMS AND CONDITIONS OF THE <br />SALE BY THE CITY OF SAN MARCOS, TEXAS OF <br />PARCEL NO. 36A-1A DESCRIBED FURTHER ON <br />EXHIBIT "A" ATTACHED HERETO, LOCATED <br />WITHIN THE TEX. A-6, NEIGHBORHOOD DEVELOP- <br />MENT PROGRAM AREA, TO MS. PINKIE LEE DOWELL; <br />AUTHORIZING THE MAYOR TO EXECUTE A WARRANTY <br />DEED TO MS. PINKIE LEE DOWELL; AND DECLARING <br />AN EMERGENCY. <br /> <br />WHEREAS, the City of San Marcos, Texas, on two separate occasions <br />advertised for bids for the sale of that certain real property <br />known as Parcel No. 36A-IA, and described more fully on Exhibit <br />"A" attached hereto, located within the Tex. R-140C, Urban Renewal <br />Project area, in the San Marcos Record, and the Hays County Citizen, <br />local newspapers with a general clrculation withln the County of <br />Hays, State of Texas; and, <br /> <br />WHEREAS, pursuant to said advertisement, a bid was submitted by <br />Ms. Pinkie Lee Dowell for said Parcel No. 36A-lA, and <br /> <br />WHEREAS, the said bid met the minimum disposition price set opon <br />said property by the Board of Commissioners of the Urban Renewal <br />Agency of the City of San Marcos, Texas; and ' <br /> <br />WHEREAS, the said Board accepted the bid as the highest and best <br />responsible bid for said property by a Resolution duly passed on <br />August 9, 1977; and <br /> <br />WHEREAS, said Resolution also approved the terms and conditions <br />for the sale of the said property and recommended the approval of <br />said purchase price and the approval of the terms and conditions <br />for the sale, as contained in the bid documents, by the City Council <br />of the City of San Marcos, Texas; and <br /> <br />WHEREAS, the aforementioned bid and proposed use set forth in said <br />bid and the sales terms and conditions pertinent thereto conform to <br />the Redevelopment Plan for the Tex. ~R-140C, Urban Renewal Project <br />Area, and conform to the Plan for the development of the City as <br />a whole; ;now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Section 1. That the terms and conditions of the sale by the City <br />of S~n Marcos, Texas of Parcel 36A-lA, wi thin the Tex. R-140C, Urban <br />Renewal Project area, and more fully described on Exhibit "A" attached <br />hereto, to Ms. Pinkie Lee Dowell are hereby approved. <br /> <br />Section 2. That the consideration for the sale for $932.00 for <br />approximately 4655 square feet is hereby approved. <br /> <br />Section 3. That the sale by the City of San Marcos is made subject <br />to restrictions of the Redevelopment Plan for the Tex. R-140C, Urban <br />Renewal Project, as approved and amended; said Plan is on file and <br />is available for inspection in the Office of the Director of <br />Community Development of the City of San Marcos. <br /> <br />Section 4. That the conditions of the disposition documents, including <br />the Deed and Contract of Sale for Private Redevelopment, are on file <br />and are available for inspection in the Office of the Director of <br />Community Development of the City of San Marcos. <br /> <br />Section 5. That the purchaser is hereby placed on notice that the <br />subject property is subject to assessment under the provisions of <br />Article ll05b of the Revised Civil Statutes of the Stiltesof Texas. <br />
