I I I 125 ORDINANCE NO. 1977 - 31 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING THE PRICE AND TERMS AND CONDITIONS OF THE SALE BY THE CITY OF SAN MARCOS, TEXAS OF PARCEL NO. 36A-1A DESCRIBED FURTHER ON EXHIBIT "A" ATTACHED HERETO, LOCATED WITHIN THE TEX. A-6, NEIGHBORHOOD DEVELOP- MENT PROGRAM AREA, TO MS. PINKIE LEE DOWELL; AUTHORIZING THE MAYOR TO EXECUTE A WARRANTY DEED TO MS. PINKIE LEE DOWELL; AND DECLARING AN EMERGENCY. WHEREAS, the City of San Marcos, Texas, on two separate occasions advertised for bids for the sale of that certain real property known as Parcel No. 36A-IA, and described more fully on Exhibit "A" attached hereto, located within the Tex. R-140C, Urban Renewal Project area, in the San Marcos Record, and the Hays County Citizen, local newspapers with a general clrculation withln the County of Hays, State of Texas; and, WHEREAS, pursuant to said advertisement, a bid was submitted by Ms. Pinkie Lee Dowell for said Parcel No. 36A-lA, and WHEREAS, the said bid met the minimum disposition price set opon said property by the Board of Commissioners of the Urban Renewal Agency of the City of San Marcos, Texas; and ' WHEREAS, the said Board accepted the bid as the highest and best responsible bid for said property by a Resolution duly passed on August 9, 1977; and WHEREAS, said Resolution also approved the terms and conditions for the sale of the said property and recommended the approval of said purchase price and the approval of the terms and conditions for the sale, as contained in the bid documents, by the City Council of the City of San Marcos, Texas; and WHEREAS, the aforementioned bid and proposed use set forth in said bid and the sales terms and conditions pertinent thereto conform to the Redevelopment Plan for the Tex. ~R-140C, Urban Renewal Project Area, and conform to the Plan for the development of the City as a whole; ;now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: Section 1. That the terms and conditions of the sale by the City of S~n Marcos, Texas of Parcel 36A-lA, wi thin the Tex. R-140C, Urban Renewal Project area, and more fully described on Exhibit "A" attached hereto, to Ms. Pinkie Lee Dowell are hereby approved. Section 2. That the consideration for the sale for $932.00 for approximately 4655 square feet is hereby approved. Section 3. That the sale by the City of San Marcos is made subject to restrictions of the Redevelopment Plan for the Tex. R-140C, Urban Renewal Project, as approved and amended; said Plan is on file and is available for inspection in the Office of the Director of Community Development of the City of San Marcos. Section 4. That the conditions of the disposition documents, including the Deed and Contract of Sale for Private Redevelopment, are on file and are available for inspection in the Office of the Director of Community Development of the City of San Marcos. Section 5. That the purchaser is hereby placed on notice that the subject property is subject to assessment under the provisions of Article ll05b of the Revised Civil Statutes of the Stiltesof Texas.
