<br />I <br /> <br />19 <br /> <br />ORDINANCE NO. 1977 -51 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, REPEALING ARTICLE II OF CHAPTER <br />5 OF THE CODE OF ORDINANCES OF SAN MARCOS, SAID <br />ARTICLE, ENTITLED flBUILDING CODEfI, HAVING BEEN <br />ADOPTED BY ORDINANCE DATED NOVEMBER 8, 1971 AND <br />AMENDED BY ORDINANCE DATED JUNE 24, 1974, AND <br />WHICH PROVIDED FOR A BUILDING CODE TO GOVERN THE <br />CONSTRUCTION, ALTERATION, REMOVAL, DEMOLITION, <br />EQUIPMENT, USE AND OCCUPANCY, AND MAINTENANCE OF <br />BUILDINGS AND STRUCTURES; ENACTING A NEW ARTICLE <br />II OF CHAPTER 5, ENTITLED flBUILDING CODE", WHICH <br />PROVIDES FOR A BUILDING CODE TO GOVERN THE CON- <br />STRUCTION,ALTERATION, REMOVAL, DEMOLITION, EQUIP- <br />MENT, USE AND OCCUPANCY, MAINTENANCE OF BUILDINGS <br />AND STRUCTURES, AND SETTING LICENSING AND PERMIT <br />FEES; AND PROVIDING AN EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Section 1. That Article II of Chapter 5 of the Code of Ordinances of <br />the City of San Marcos, Texas, entitled "Building Codefl, which was <br />adopted by ordinance dated November 8, 1971, and amended by ordinance <br />dated June 24, 1974, be, and is hereby, repealed. <br /> <br />I <br /> <br />Section 2. That there is hereby adopted by the City of San Marcos, <br />Texas, for the purpose of establishing rules and regulations governing <br />the construction, alteration, removal, demolition, equipment, use and <br />occupancy, location, and maintenance of buildings and structures in- <br />cluding permits and penalties, that certain building code known as the <br />flStandard Building Code", being particularly the "1977 Edition" thereofl <br />and the "1978 Revision" thereto, save and except such portions as are <br />hereinafter modified or amended, of which not less than three copies <br />of both said Code and Revision have been and now are filed in the <br />office of City Secretary of the City of San Marcos, and the same are <br />hereby adopted and incorporated as fully as if set out full length <br />herein, and from the date on which this ordinance 'shall take effect, <br />the provisions thereof shall be controlling in the construction of all <br />buildings and other structures therein contained within the corporate <br />limits of the City of San Marcos, Texas. <br /> <br />Section 3. The said flStandard Building Codefl is amended and changed <br />in the following respects: <br /> <br />(1) <br /> <br />Section 114 of said Code is amended so that it will now read- <br />as follows: <br /> <br />I <br /> <br />Any person, firm, corporation, or agent who shall violate a <br />provision of this COde, or fail to comply therewith, or with <br />any of the requirements thereof, or who shall erect, construc~ <br />alter, demolish or move any structure, or has erected, con- <br />structed, altered, repaired, moved or demolished a building <br />or structure in violation of a detailed statement or drawing <br />submitted and approved thereunder, shall be deemed guilty of <br />a misdemeanor. Each such person shall be deemed guilty of a <br />separate offense for each and every day or portion thereof <br />during which any violation of any of the provisions of this <br />Code is committed, or continued, and, upon conviction of any <br />such violation such person shall be punished by a fine of not <br />less than Ten Dollars ($10.00) and not more than Two Hundred <br />Dollars ($200.00). The imposition of the penalties herein <br />prescribed shall not preclude the City of San Marcos from <br />instituting an appropriate action or proceeding to prevent an <br />unlawful erection, construction, reconstruction, alteration, <br />repair, conversion, maintenance or use, or to restrain, <br />correct or abate a violation, or to prevent the occupancy of <br />a building or structure or portion, thereof, or of the premis <br />or to prevent an illegal act, conduct, business or use in or <br />about any premises. <br /> <br />(2 ) <br /> <br />Chapter 3, shall be deleted in its entirety. <br />
