<br />AN ORDINANCE OF THE CITY COUN~IL OF THE CITY OF
<br />SAN MARCOS, TEXAS, AMENDING ARTICLE II OF CHAP-
<br />TER 26 OF THE SAN MARCOS CODE OF ORDINANCES, EN-
<br />TITLED flHOTEL OCCUPANCY TAX", WHICH WAS ADOPTED
<br />BY ORDINANCE NO. 1972-20, ON JUNE 26, 1972, RE-
<br />CORDED IN VOL. 40, PAGE 137 OF THE MINUTES OF
<br />THE CITY COUNCIL, BY CHANGING THE AMOUNT OF TAX
<br />TO BE LEVIED FROM 3% TO 4% IN SECTION 2(a) OF
<br />SAID ORDINANCE, AND BY PROVIDING ADDITIONAL
<br />USES OF SAID TAX REVENUES AS SET OUT IN SECTION
<br />6 OF SAID ORDINANCE; AND PROVIDING AN EF'FECTIVE
<br />DATE.

<br />WHEREAS, the 65th Legislature, during the 1977 Legislative Session,
<br />passed an Act amending Article 1269J-4.1 of Vernons' Texas Civil
<br />Statutes by increasing the amount of hotel occupancy tax which a
<br />city may levy from 3% to 4% and by providing for additional uses for
<br />such funds; and,
<br />
<br />WHEREAS, the City Council desires to adopt such legi~lative changes
<br />in the City of San Marcos by amending the existing Hotel Occupancy
<br />Tax ordinance, codified as Article II of Chapter 26 of the San Marcos
<br />Code of Ordinances; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />Part 1. That Section 2(a) of said ordinance be hereby amended to
<br />read as follows:

<br />(a) There is hereby levied a tax upon the cost of occupancy of
<br />any room or space furnished by any hotel where such cost of
<br />occupancy is at the rate of Two Dollars ($2.00) or more per
<br />day, such tax to be equal to four percent (4%) of the con-
<br />sideration paid by the occupant of such room, space or
<br />facility to such hotel, exclusive of other occupancy taxes
<br />imposed by other governmental agencies.
<br />
<br />Part 2. That Section 6 of said Ordinance be hereby amended by re-
<br />placing paragraph 6(a) with a new paragraph to read as follows:
<br />
<br />(a) For the acquisition of sites for and the construction, im-
<br />provement, enlarging, equipping, repairing, operation, and
<br />maintenance of convention center facilities including, but
<br />not limited to, civic center convention buildings, auditoriums,
<br />coliseums, civic theaters, museums, 'and parking areas or
<br />facilities for the parking storage of motor vehicles or Qther
<br />conveyances located at or in the immediate vicinity of the
<br />convention center facilities.

<br />Part 3. That Section 6 of said Ordinance be hereby further amended
<br />by the inclusion of two additional paragraphs to read as follows:

<br />(f) For the encouragement, promotion, improvement, and appLcca-
<br />tion of the arts, including music (instrumental and vocEll),
<br />dance, Jrama, folk art, creative writing, architecture,
<br />design and allied fields, painting, sculpture, photography,
<br />graphic and craft arts, motion pictures, television, radio,
<br />tape and sound recording, and the arts related to the pre-
<br />sentation, performance, execution, and exhibition of these
<br />major art forms.
<br />
<br />(g) For historical preservation and restoration.
<br />
<br />Part 4. Tnat this Ordinance shall be in full force and effect ten
<br />(10) days from and after its final passage.
