I I I 219 I ORDINANCE NO. 1977 - 60 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS ANNEXING TO SAID CITY A CON- TIGUOUS TRACT OF LAND CONTAINING 14.50 ACRES LOCATED WIlliIN THE EXTRATERRITORIAL JURISDIC- TION OF SAID CITY AND LYING AWACENT TO PRESENT CITY BOUNDARIES; AND ESTABLISHING ZONING FOR SAID TRACT. WHEREAS, Winfield S. Radar, the sole owner of a tract of land containing 14.50 acres, which land is contiguous and adjacent to present City boundaries and located within said City's extraterritorial jurisdiction, has duly petitioned, by written petition, the City of San Marcos to annex said tract to be hereafter incorporated for all purposes within the boundaries of said City; and WHEREAS, said petition has been heard and considered by the City Council, which determined that annexation of said tract as a single family residential (R-l) area would be in the best interest of the public and the City of San Marcos, and WHEREAS, the 65th Legislature of Texas amended Paragraph (a), Subsection B-1, Section 7, Article I, Municipal Annexation Act (Article 970a V.A.T.S.) to provide for such annexation initiated upon written petition of the owner of the area to be annexed; and WHEREAS, a copy of said petition is attached hereto and incorporated herein for all intents and purposes as "EXHIBIT A"; and WHEREAS, a description of said tract by plat and by metes and bounds is attached hereto and incorporated herein for all intents and purposes cs "EXHIBIT B"; and WHEREAS, said petition for annexation should be and is hereby granted; now, therefore; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PARI' 1. That the 14.50 acres tract, part of and out of the T. J. Charmers Survey, Abstract Nwnber 2 of Hays County, Texas, and owned by Winfield S. Radar, said tract being more fully described by plat and by metes and bounds description in "EXHIBIT B" attached hereto and incorporated herein, be and is hereby annexed into the incorporated area of the City of SiID Marcos. PART 2. That the corporate limits of said City be and are hereby extended to include said newly annexed 14.50 acre tract. PARI' 3. That said 14.50 acre tract be, and is, hereby, zoned "R-l", single family residential. PART 4. That said 14.50 acre tract shall henceforth be a part of the City of San Marcos, and the inhabitants thereof shall be entitled to all the rights and privileges of all citizens, and shall be bound by the acts and ordinances, resolutions and regulations of the City. PARI' 5. That this Ordinance shall be in full force and effect ten days from and after final passage and publication in a newspaper of general circulation.
