ORDINANCE NO. 2010 -22 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE <br />FUTURE LAND USE MAP FROM "VLDR'" VERY LOW DENSITY <br />RESIDENTIAL TO "MDR" MEDIUM DENSITY RESIDENTIAL FOR <br />A 33.20 ACRE, MORE OR LESS, TRACT OF LAND OUT OF THE <br />THOMAS J. CHAMBERS SURVEY ABSTRACT NO. 2; AND <br />INCLUDING PROCEDURAL PROVISIONS <br />RECITALS: <br />1. On December 8, 2009 and April 13, 2010, the Planning and Zoning Commission of <br />the City of San Marcos held public hearings regarding a request to change the Future Land Use <br />Map of the San Marcos Horizons City Master Plan from "VLDR" Very Low Density Residential <br />to "MDR" Medium Density Residential, for a 33.20 acre, more or less, tract of land out of the <br />Thomas J. Chambers Survey Abstract No. 2. <br />2. Subsequent to the public hearings on said dates, the Planning and Zoning Commission <br />considered and voted to approve the request on April 13, 2010, and recommended that the <br />requests be approved by the City Council of the City. <br />3. The City Council held a public hearing on May 4, 2010 regarding the request. <br />• <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is <br />revised to change the future land use designation for the following real property from "VLDR" <br />Very Low Density Residential to "MDR" Medium Density Residential: <br />Legal description: A 33.20 acre, more or less, tract of land out of the Thomas J. <br />Chambers Survey Abstract No. 2 as described in exhibit "A ", attached hereto. <br />SECTION 2. After its original passage, this ordinance will be subject to reconsideration <br />at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is <br />reconsidered and approved, it shall become effective ten days thereafter. <br />PASSED, APPROVED AND ADOPTED on May 4, 2010, subject to <br />• reconsideration at the next regular City Council meeting scheduled for May 18, 2010. <br />
