115 I ORDINANCE NO. 1976 - 32 AN ORDINANCE OF THE CITY COUNCIL OF TIlE CITY OF SAN MARCOS, TEXAS, AUTHORIZING THE MAYOR OF TIlE CITY OF SAN MARCOS TO EXECUTE A QUITCLAIM DEED ON BEHALF OF THE CITY TO TIlE RIGHT-OF-WAY PRESENTLY BEING USED BY TIlE PUBLIC ON THAT PROPERTY Ca.MJNLY KNOWN AS "THE OLD MILL PROPERTY" SITIJATED IN THE CITY OF SAN MARCOS, TEXAS, TO THE ABUITING PROPERTY OWNERS, AND DECLARING AN EMERGENCY. 1 WHEREAS, the City Council of the City of San Marcos, Texas has adopted, on May 24, 1976, an ordinance closing and abandoning the right-of-way presently being used by the public on that property commonly known as "the Old Mill Property" situated in the City of San Marcos, Texas; and WHEREAS, the City Council by that same ordinance authorized the Mayor to execute a quitclaim deed to said right-of-way to the abutting prcperty owners; and WHEREAS, the deed subsequently executed _by the Mayor, .on behalf of the City of San Marcos, contained an incorrect description of the property being quitclaimed by the City; now, therefore, BE IT ORDAINED BY TIlE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS SECTION 1. That the Mayor is hereby authorized to execute a correction deed to the right-of-way presently being used by the public on that property commonly knOwn as "the Old Mill Property" and situated in the City of San Marcos, Texas. 1 SECTION 2. That the importance of this Ordinance creates an ~nergency and an imperative purpose necessary that.the provisions of the_ Charter requiring that all Ordinances be read at three separate meetings. and that no Ordinance shall become effective until the expiration of 10 days following the date of its final passage, be suspended, and this provision is hereby suspended, and this Ordinance.shall take effect and be in force from and after its adoption.
