<br />116 <br /> <br />ORDINANCE NO. 1975 - 43 <br /> <br />AN ORDINANCE OF TEE CITY OF SAN Ml'.RCOS, TEXAS, <br />AMENDING ARTICLE III, SECTION 26-30 OF CHAPTER <br />26 OF TEE CODE OF ORDINANCES OF SAID CITY BY <br />ADDING $2000 TO TEE HOMESTEAD EXEMPTION OF THE <br />ELDERLY SO AS ~O PROVIDE A TOTAL EXEMPTION OF <br />$5 ,000; AND DECLARING AN EMERGENCY. <br /> <br />I <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas has previously <br />provided a $3,000 homestead tax exemption for the elderly and the City Council <br />now wishes to extend said exemption to $5,000; and <br /> <br />WHEREAS, in order to plan and provide for such exemption for the coming fiscal <br />year it is mandatory to provide such tax exemption increase on an emergency <br />basis; now, therefore, <br /> <br />BE IT ORDAINED BY TEE CITY COUNCIL OF TEE CITY OF SAN Ml'.RCOS, TEXAS: <br /> <br />SECTION 1. That Article III, Sec. 26-30 of Chapter 26 of the Code of Ordinances <br />be, and is hereby, amended by deleting the phrase "Three Thousand Dollars ($3,000)" <br />from said section and adding the phrase "Five Thousand Dollars ($5,000)" so as to <br />cause said section to read as follows: <br /> <br />Upon compliance with all requirements of this article and all other <br />applicable laws and resolutions, Five Thousand Dollars ($5,000) of the <br />assessed value of residence homesteads of persons sixty-five (65) years <br />of age or older shall be exempt from ad valorem taxes levied by the City <br />of San Marcos, Texas. <br /> <br />I <br /> <br />SECTION 2. The public welfare being endangered due to the fact it ,is necessary <br />to plan and provide for this exemption for the coming fiscal year; therefore, an <br />emergency exists, requiring that the provisions of the Charter of the City of <br />San Marcos, Texas, which ordinarily require ordinances to be read on three (3) <br />several days and that no ordinances shall become effective until the expiration of <br />ten (10) days following the date of its final passage, be dispensed with.
