<br />162 <br /> <br />ORDINANCE NO. 1974 - 30 <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, DEDICATING <br />CERTAIN LAND OUT OF THAT TRACT KNOWN AS THE OLD SEWER <br />TREATMENT PLANT TO USE AS PARKLAND ONLY PURSUANT TO SECTION <br />3.07 OF THE CHARTER OF THE CITY OF SAN MARCOS, TEXAS. <br /> <br />I <br /> <br />WHEREAS, that certain tract of land known as the Memorial Park Baseball <br />Field has been removed from park use by the voters of said City on April <br />2, 1974, as evidenced by an ordinance to that effect dated June 10, 1974; <br />and, <br /> <br />WHEREAS, the City Council desires to dedicate a comparable tract of land <br />known as the Old Sewer Treatment Plant for parkland use only; and, <br /> <br />WHEREAS, said tract will be henceforth controlled by the restrictions <br />contained in Section 3.07 of the Charter of the City of San Marcos, Texas; <br />now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Section 1. That that certain tract of land as described herein, be, and <br />is hereby dedicated to use as parkland and park purposes, pursuant to Section <br />3.07 of the Charter of the City of San Marcos, Texas, said tract being known <br />as a portion of the Old Sewer Treatment rlant and being more particularly <br />described as follows: <br /> <br />BEGINNING at a point being the most southerly corner of a tract of <br />land conveyed to the City of San Marcos by L.O. Lester, Volume 148, <br />Page 138 of the Hays County Deed Records dated November 3, 1950; <br /> <br />I <br /> <br />THENCE North 450 25' East passing at 540 feet the centerline of a <br />15 foot easement conveyed to Luis and Petra Gil and duly recorded in <br />Volume 145, Page 618 and continuing a total distanee of 844.9 feet <br />to a point on the southeast right-of-way of I.H. 35; <br /> <br />THENCE with the southeast right-of-way of I.H. 35 north 380 19' <br />east an approximate distance of 730 feet to a point on the northeast <br />side of an easement granted to Luis and Petra Gil and duly recorded <br />in Volume 145, Page 618 of Hays County Deed Records; <br /> <br />THENCE with the northeast line of said easement south 460 20' east <br />and passing at approximately 405 feet, the point of intersection of <br />the northeast line of easement bearing north 460 20' west and the <br />southeast line of said easement bearing north 450 00' east and con- <br />tinuing south 460 and 20' east for a total distance of approximately <br />925 feet to a point of the southeast side of this tract; <br /> <br />I~ THENCE south 440 53' west an approximate distance of 728 feet to the <br />point of Beginning containing approximately 14.75 acres. <br /> <br />S~ction 2.
