<br />163 <br /> <br />ORDINANCE NO. 1974 - 31 <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, REMOVING <br />THE DEDICATION FOR PARKLAND USE ONLY FROM A CERTAIN TRACT <br />OF LAND WITHIN SAID CITY. <br /> <br />WHEREAS, the City Charter of the City of San Marcos, Texas, provides for <br />the method of removing parkland dedication from land so dedicated by Section <br />3.07 of said Charter; and <br /> <br />I <br /> <br />WHEREAS, on August 28, 1922, a certain tract of land commonly known as the <br />Memorial Park Baseball Field was dedicated to parkland use only; and, <br /> <br />HWEREAS, puusuant to Section 3.07 of said Charter, a referendum election <br />was held in conjunction with the Regular City Election on April 2, 1974, <br />calling for the voters of said City to express their desire concerning the <br />removal of said dedication; and, <br /> <br />WHEREAS, on April 2, 1974, the voters voted in favor of removing said <br />dedication, as verified by the subsequent canvassing of the ballots cast <br />in said election held on April 3, 1974; and, <br /> <br />WHEREAS, the City Council now desires to remove said tract from use as <br />parkland only; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Section 1. That the dedication for parkland use only placed upon that <br />certain tract of land as hereinafter described, as evidenced by ordinance <br />dated August 28, 1972, be and is hereby removed, pursuant to the terms and <br />provisions of Section 3.07 of the City Charter of the City of San Marcos, <br />said tract being more particularly described as follows: <br /> <br />I <br /> <br />BEGINNING at an iron pipe being a corner of a 53.8 acre tract out of <br />the J.M. Veramendi League No. Two being situated on the east side of <br />the San Marcos River, said iron pipe bears N 440 13' E 827.3 feet <br />from an iron pipe at the head of a ravine; <br /> <br />THENCE south 410 21' east an approximate distance of 672.0 feet to a <br />point on the northwest right-of-way line of the N.K.T. Railroad; <br /> <br />THENCE with the curving line of said right-of-way line an approximate <br />distance of 940.0 feet to a point on the northeast line of said 53.8 <br />acre tract deeded to the San Marcos Memorial Recreation Park by <br />Victor W. and Ruth Munk as recorded in Volume 114, Page 190, Hays <br />County Deed Records; <br /> <br />THENCE with the northwest line of said 53.8 acre tract north 450 55' <br />west an approximate distance of 153.0 feet to a point on the south <br />right-of-way line of Ranch Road No~ 12, also known as Hopkins Street, <br />at approximately Engineer's Station 95 + 88; <br /> <br />THENCE following the curving line of said Ranch Road 12 right-of-way <br />in a westerly direction an approximate distance of 1050.0 feet to a <br />point at approximately Engineer's Station 85+12; <br /> <br />THENCE south 410 21' east an approximate distance of 148.0 feet to the <br />POINT OF BEGINNING and containing approximately 14.75 acres. <br /> <br />I <br /> <br />Section 2. This ordinance shall become effective ten (10) days from and <br />after final passage by the City Council. <br /> <br />PASSED AND APPROVED on first reading May 13, 1974. <br /> <br />PASSED AND APPROVED on second reading May 28, 1974. <br /> <br />PASSED, APPROVED AND ADOPTED June 10, 1974. <br />
