<br />27 <br /> <br />RESOLUTION NO. 1974-24-R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS,TEXAS, ADOPTING <br />AND APPROVING A MAINTENANCE AGREEMENT <br />WITH THE BICENTENNIAL COMM1SION OF THE <br />CITY OF SAN MARCOS, TEXAS, FOR THE MAIN- <br />TENANCE OF THE RIVERWALK ON THE SAN <br />MARCOS RIVER, SAN MARCOS, TEXAS. <br /> <br />I <br /> <br />WHEREAS, the Bicentennial Commission of the City of San <br />Marcos has constructed and presently maintains Riverwalk along the <br />San Marcos River in said City; and, <br /> <br />WHEREAS, the City Council of the City of San Marcos desires <br />to maintain said Riverwalk pursuant to the~public health, safety, <br />and welfare; now, therefore, <br /> <br />TEXAS: <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> <br />PART 1. That the City Council hereby adopts and approves a <br />maintenance agreement with the Bicentennial Commission of San Marcos, <br />Texas, providing for the maintenance of the Riverwalk along the <br />San Marcos River in said City pursuant to the letter of agreement <br />attached hereto and made a part hereof for all intents and purposes. <br /> <br />PART 2. That the City of San Marcos shall maintain said <br />Riverwalk at its own expense and shall preserve said Riverwalk in <br />its present form and as hereinafter improved. <br /> <br />PART 3.
