47 ORDINANCE NO, 1974 ~ 48 I AN ORDINANCE DEDICATING A CERTAIN TRACT OF REALTY FOR THE PURPOSE OF A PUBLIC MUSEUM; SAID TRACT TO BE USED FOR A MUSEUM, CONSTRUC- TED UNDER THE MANAGEMENT OF THE TEXAS MUSEUM OF HISTORY, INC.; PROVIDING FOR THE BUILDING TO BE COMPLETED WITHIN FIVE (5) YEARS FROM THE EFFECTIVE DATE OF THIS ORDINANCE; AUTHOR- IZING THE CITY MANAGER OF SAN MARCOS TO ENTER INTO CONTRACTUAL AGREEMENTS WITH TEXAS MUSEUM OF HISTORY, INC., AND TO TAKE ALL STEPS NECESSARY TO EFFECTUATE THE INTENTS AND PURPOSES EXPRESSED HEREIN. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That a certain tract of real property dedicated to use for public museum purposes by deed executed by the Urban Renewal Agency of the City of San Marcos, Texas, and more particu- larly described as follows: See Attached "Exhibit A" be, and is hereby, designated for the site and location of a public museum. I SECTION 2. That the City Council hereby expresses its desire to enter into contractual agreements with Texas Museum of History, Inc., for the placement of a museum building on said site. SECTION 3. That Texas Museum of History, Inc., is hereby given the power to control, manage, and generally supervise the process of constructing and completing the building which is to be used for the said museum purposes. SECTION 4. That the City of San Marcos, Texas, shall have no obligation whatsoever in funding or paying for any part of the cost of such museum building. SECTION 5. That Texas Museum of History, Inc., will retain the aforesaid power for five (5) years from the effective date of this ordinance; it being the will and intent of the City Council that the aforesaid museum building be completed within five (5) years from the effective date of this ordinance. SECTION 6. That the City shall retain ownership of the reality, shall also own the museum building to be constructed on the realty, and shall not permit any construction to commence until the City enters into a satisfactory agreement with the Texas Museum of History, Inc., for said construction and funding of said building. I SECTION 7. That upon completion of the construction of said museum building, Texas Museum of History, Inc., be, and is hereby, authorized to sit in an advisory capacity to this City in the operation and management of the museum.
