91 I I I I, RESOLUTION NO. 1974-33-R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING THE MAYOR OF SAID CITY TO EXECUTE ON BEHALF OF THE CITY A RELEASE TO THE NATIONAL GUARD OF TEXAS RELIEVING THE NATIONAL GUARD FROM LIABILITY THAT MAY BE INCURRED BY THE NATIONAL GUARD IN PERFORMING DIRT WORK FOR THE CONSTRUCTION OF A NEW BASEBALL FIELD AT THE SAN MARCOS HIGH SCHOOL LOCATION. WHEREAS, the City Council of the City of San Marcos, Texas, is determined that it desires to construct a baseball field at San Marcos High School; and, WHEREAS, the National Guard of Texas has agree~ to perform the dirt work in preparation for construction of said baseball field; and, WHEREAS, it is necessary to execute a release from liability running to the benefit of the National Guard in order to secure said performance; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: !, I PART 1. That the Mayor of the City of San Marcos, Texas, Dr. Emmie Craddock, or her successor, be, and is hereby, authorized to execute on behalf of the City of San Marcos a release of liability running to the benefit of the National Guard of Texas for work performed in preparation of a baseball field site located at San Marcos High School, San Marcos, Texas, a copy of said release being attached hereto and marked as Exhibit A and incorporated herein for all intents and purposes. PART 2. That this resolution shall take effect immediately from and after its passage.
