<br />91 <br /> <br />I <br />I <br />I <br />I, <br /> <br />RESOLUTION NO. 1974-33-R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AUTHORIZING THE MAYOR OF SAID CITY TO EXECUTE ON <br />BEHALF OF THE CITY A RELEASE TO THE NATIONAL GUARD OF TEXAS <br />RELIEVING THE NATIONAL GUARD FROM LIABILITY THAT MAY BE <br />INCURRED BY THE NATIONAL GUARD IN PERFORMING DIRT WORK FOR <br />THE CONSTRUCTION OF A NEW BASEBALL FIELD AT THE SAN MARCOS <br />HIGH SCHOOL LOCATION. <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, is determined <br />that it desires to construct a baseball field at San Marcos High School; and, <br /> <br />WHEREAS, the National Guard of Texas has agree~ to perform the dirt work in <br />preparation for construction of said baseball field; and, <br /> <br />WHEREAS, it is necessary to execute a release from liability running to the <br />benefit of the National Guard in order to secure said performance; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />!, <br />I <br /> <br />PART 1. That the Mayor of the City of San Marcos, Texas, Dr. Emmie Craddock, <br />or her successor, be, and is hereby, authorized to execute on behalf of the <br />City of San Marcos a release of liability running to the benefit of the <br />National Guard of Texas for work performed in preparation of a baseball field <br />site located at San Marcos High School, San Marcos, Texas, a copy of said <br />release being attached hereto and marked as Exhibit A and incorporated herein <br />for all intents and purposes. <br /> <br />PART 2.
