97 ORDINANCE NO. 1974 - 69 I AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CERTAIN SECTIONS OF CHAPTER 29, ENTITLED "TRAFFIC", ARTICLE V, ENTITLED "TRAFFIC CONTROL DEVICES", AND ARTICLE VII, ENTITLED "STOPPING, STANDING AND PARKING", SO AS TO PLACE THE AUTHORITY AND RESPONSIBILITY UPON THE TRAFFIC ENGINEER FOR THE CITY OF SAN MARCOS FOR THE PURPOSES OF ERECTING AND MAINTAINING TRAFFIC CONTROL SIGNS, SIGNALS, AND DEVICES AS DIRECTED BY THE CITY COUNCIL; AND ENFORCING PARKING REGULATIONS; AND THEREBY DIVESTING THE POLICE DEPARTMENT OF THE CITY FROM SUCH AUTHORITY AND RESPONSIBILITY. WHEREAS, the City Council of the City of San Marcos, Texas, desires to remove from the responsibility of maintaining Traffic Control Signs, Signals, and Devices and desires to place that responsibility and power in the Traffic Engineer for the City of San Marcos; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS. TEXAS: SECTION 1. That Section 29-110, entitled "General Powers and Duties of the Council relative to the devices", Section 29-110.1, entitled "To Be Placed To Be Maintained At or Near Specific Street Intersections", Section 29-144. entitled "On Parade or Procesion Routes", Section 29-149, entitled "Designation and Marking of Parking Stalls and Areas Where Parkin!'; is Prohibited or Limited", Section 29-169, entitled "Collection and Disposition of Meter Funds", Section 29-171, entitled "Violations of Division-Report Required", and Section 29-172, entitled "Same - Notice to be Attached to Vehicle", be, and is hereby, amended so as to delete all reference to the Police Department, Chief of Police, and Police Officers; and substituting in their place the words Traffic Engineer for the City, so that the sections named above shall read as follows: I Section 29-110. General Powers and Duties of Council Relative to Devices. The City Council through the Traffic Engineer of the City shall place and maintain traffic control signs.... Section 29-144. On Parade or Procession Routes. The Traffic En!';ineer is hereby authorized,... Section 29-149. Designation and Markin!'; of Parking Stalls and Areas Where Parking is Prohibited or Limited. (a) The Traffic Engineer of the City shall cause parkin!'; stalls .to be maintained. .. Section 29-169. Collection and Disposition of Meter Funds. (a) It shall be the dute of the Traffic Engineer, with the approval of the City Council, to designate some member or members of his department to make regular collections of the money deposited in parking meters.... Section 29-171. Violations of Division - Report Required. It shall be the duty of the Traffic Engineer to report;... Section 29-172. Same - Notice to be Attached to Vehicle. Each Traffic Engineer shall attach to any vehicle found parked in violation of this devision a notice... I
