<br />97 <br /> <br />ORDINANCE NO. 1974 - 69 <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING <br />CERTAIN SECTIONS OF CHAPTER 29, ENTITLED "TRAFFIC", <br />ARTICLE V, ENTITLED "TRAFFIC CONTROL DEVICES", AND ARTICLE <br />VII, ENTITLED "STOPPING, STANDING AND PARKING", SO AS TO <br />PLACE THE AUTHORITY AND RESPONSIBILITY UPON THE TRAFFIC <br />ENGINEER FOR THE CITY OF SAN MARCOS FOR THE PURPOSES OF <br />ERECTING AND MAINTAINING TRAFFIC CONTROL SIGNS, SIGNALS, <br />AND DEVICES AS DIRECTED BY THE CITY COUNCIL; AND ENFORCING <br />PARKING REGULATIONS; AND THEREBY DIVESTING THE POLICE <br />DEPARTMENT OF THE CITY FROM SUCH AUTHORITY AND RESPONSIBILITY. <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, desires to remove <br />from the responsibility of maintaining Traffic Control Signs, Signals, and <br />Devices and desires to place that responsibility and power in the Traffic <br />Engineer for the City of San Marcos; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS. TEXAS: <br /> <br />SECTION 1. That Section 29-110, entitled "General Powers and Duties of the <br />Council relative to the devices", Section 29-110.1, entitled "To Be Placed <br />To Be Maintained At or Near Specific Street Intersections", Section 29-144. <br />entitled "On Parade or Procesion Routes", Section 29-149, entitled "Designation <br />and Marking of Parking Stalls and Areas Where Parkin!'; is Prohibited or Limited", <br />Section 29-169, entitled "Collection and Disposition of Meter Funds", Section <br />29-171, entitled "Violations of Division-Report Required", and Section 29-172, <br />entitled "Same - Notice to be Attached to Vehicle", be, and is hereby, amended <br />so as to delete all reference to the Police Department, Chief of Police, <br />and Police Officers; and substituting in their place the words Traffic Engineer <br />for the City, so that the sections named above shall read as follows: <br /> <br />I <br /> <br />Section 29-110. General Powers and Duties of Council Relative to Devices. <br />The City Council through the Traffic Engineer of the City shall <br />place and maintain traffic control signs.... <br /> <br />Section 29-144. On Parade or Procession Routes. <br />The Traffic En!';ineer is hereby authorized,... <br /> <br />Section 29-149. Designation and Markin!'; of Parking Stalls and Areas <br />Where Parking is Prohibited or Limited. <br />(a) The Traffic Engineer of the City shall cause parkin!'; stalls <br />.to be maintained. .. <br /> <br />Section 29-169. Collection and Disposition of Meter Funds. <br />(a) It shall be the dute of the Traffic Engineer, with the <br />approval of the City Council, to designate some member <br />or members of his department to make regular collections <br />of the money deposited in parking meters.... <br /> <br />Section 29-171. Violations of Division - Report Required. <br />It shall be the duty of the Traffic Engineer to report;... <br /> <br />Section 29-172. Same - Notice to be Attached to Vehicle. <br />Each Traffic Engineer shall attach to any vehicle found parked <br />in violation of this devision a notice... <br /> <br />I <br />
