121 ORDINANCE NO. 1974 - 77 I AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, ilMENDING THAT CERTAIN ORDINANCE NUMBERED 1966-19 AND CODIFIED AS APPENDIX A OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, AND KNOWN AS THE GENERAL ZONING ORDINANCE BY ADDING TO SECTION 2 OF SAID ORDINANCE A PARAGRAPH LETTERED "D" ESTABLISHING A WAITING PERIOD OF 12 MONTHS FOR THE FILING OF REAPPLICATION FOR CHANGE OF ZONING. WHEREAS, the City Council of the City of San Marcos, Texas, is of the opinion that requests for changes of zoning should be regulated so as to require a waiting period before reapplication will be considered; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That that certain Ordinance numbered 1966-19, known as the "General Zoning Ordinance" and codified as Appendix A of the Code of Ordinances of the City of San Marcos, Texas, be, and is hereby, amended by adding to Section 20f said Ordinance a paragraph lettered "D" so that Section 2, paragraph D shall read as follows: 2.D. When all conditions listed below are present in a request for zoning change the Commission and City Council shall not hear said request: 1.) The subject land has previously been denied the same request for a zoning change within the last twelve (12) months. I 2.) Within the determination of the Planning and Zoning Administrator, a substantial change in conditions surrounding the subject land has not occurred since the prior request. SECTION 2. That this Ordinance shall take effect ten (10) days from and after its final passage. PASSED AND APPROVED on first reading November 11, 1974. PASSED AND APPROVED on second reading November 25, 1974.
