<br />ORDINANCE NO. 1974 - 78

<br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, APPROVING
<br />THE TRAJ1SFER OF FRANCHISE FOR CABLE TELEVISION WITHIN THE
<br />CITY OF SAN MARCOS PREVIOUSLY GRANTED TO COMMCO OF SAN
<br />MARCOS, INC., TO KARNACK CORPORATION OF AUSTIN, TEXAS.

<br />WHEREAS, Commco of San Marcos, Inc., and Karnack Corporation have requested
<br />a transfer of franchise; and,
<br />
<br />WHEREAS, Commco has agreed to give up its franchise in favor of Karnack
<br />Corporation; and,
<br />
<br />WHEREAS, it is the opinion of the City Council that said transfer is in
<br />conformity to Article II of the Charter of the Citv of San Marcos, Texas;
<br />and,
<br />
<br />WHEREAS, Karnack Corporation of Austin, Texas has agreed to abide by the
<br />ordinance establishing the franchise to Commco of San Marcos; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COL~CIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That the request of,Commco of San Marcos, Inc., and Karnack Corporation
<br />petitioning the City of San Marcos a transfer of franchise for cable T.V. held
<br />by Commco of San Marcos, Inc., be, and is hereby, approved by the City of
<br />San Marcos, Texas.
<br />
<br />SECTION 2. That the words Commco of San Marcos, Inc., be, and is hereby,
<br />deleted from the Ordinance granting franchise to said corporation for the
<br />operation of a cable television company within the City of San Marcos and
<br />substitute in its place the words Karnack Corporation so as to transfer the
<br />franchise held by Commco of San Marcos, Inc., into the possession and ownership
<br />of Karnack Corporation of Austin, Texas.

<br />SECTION 3. That upon the request of Karnack Corporation, the franchise shall
<br />be, and is hereby, amended by extending for an additional two {2) years so as
<br />to give said corporation a franchise through December, 1989.
<br />
<br />SECTION 4. That upon the request of the City, the franchise shall be, and is
<br />hereby, amended so as to provide that in the event the City Council either
<br />initiates a rate change or is petitioned by Karnack Corporation to consider a
<br />rate change, the moving party shall pay all reasonable expenses incurred by the
<br />other for outside services necessary for consideration of the proposed rate change.
<br />
<br />SECTION 5. That Karnack Corporation succeed to the rights, responsibilities, and
<br />duties imposed by the franchise agreement so that from this time forward, Karnack
<br />Corporation of Austin be, and is hereby, acknowledged as holding the franchise,
<br />the operation of cable television within the City of San Marcos, Texas.
<br />
<br />SECTION 6. That this Ordinance shall take effect ten (10) days from and after
<br />its passage.
<br />
<br />PASSED AND APPROVED on first reading November 11, 1974.

<br />PASSED AND APPROVED on second reading November 25, 1974.
