21 RESOLUTION NO. 1973-23-R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AUTHORIZING THE CITY ATTORNEY TO PREPARE AND THE CITY MANAGER TO EXECUTE CERTAIN RESTRICTIVE COVENANTS TO BE ADDED TO A CERTAIN WARRANTY DEED DATED NOVEMBER 6, 1972 WHEREBY THE URBAN RENEWAL AGENCY OF THE CITY OF SAN MARCOS CONVEYED UNTO THE CITY OF SAN MARCOS A CERTAIN TRACT OF LAND TO BE USED FOR SWIMMING POOL PURPOSES. WHEREAS, on November 6, 1972 the City of San Marcos, as f grantee, was conveyed a certain tract of land, more particularly described as follows; to-wit: PARCEL Il-lB: Being 1.3613 acres of land located in the Katy Addition to the Town of San Marcos, Hays County, Texas, Plat or Map of said addition being of record in volume 34 on Page 117 of the Deed Records of Hays County, Texas, said 1.3613 acres of land being more particularly described by metes and bounds as follows, to-wit: COMMENCING at the intersection of the east right-of-way line of Northcraft Street, based on a width of 60.00 feet, with the southeasterly right-of-way line of the M.K.&T Railroad (Missouri, Kansas, and Texas) based on width of 200.0 feet; THENCE North 56 deg. 54 min. 54 sec. East, along the said south- easterly right-of-way line of the M.K.&T. Railroad, a distance of 174.69 feet to the PLACE OF BEGINNING of the hereinafter described tract; f THENCE North 56 deg. 54 min. 54 sec. East, continuing along the said southeasterly right-of-way line of the M.K.&T. Railroad, a distance of 196.53 feet to a point for corner; THENCE South 09 deg. 25 min. 00 sec. east, parallel to and 340.00 feet east of the said east right-of-way line of Northcraft Street, a distance of 369.90 feet to a point for corner; THENCE North 80 deg. 35 min. 00 sec. West, a distance of 180.00 feet to a point for corner; THENCE North 09 deg. 25 min. 00 sec. West, parallel to and 160.00 feet east of the said east right-of-way line of Northcraft Street, a distance of 290.00 feet to the PLACE OF BEGINNING and containing 1.3613 acres of land. And said tract being conveyed unto the City of San Marcos by the San Marcos Urban Renewal Agency for the purpose of constructing a swimming pool on said tract of land; and, WHEREAS, the Urban Renewal Agency of the City of San Marcos does now request the execution of certain restrictive covenants to be added to said deed; and, I WHEREAS, the City Council is of the opinion that said re- strictive covenants should be added; now, therefore,
