ORDINANCE 1981-46 <br /> <br />85 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, ANNEXING TO SAID CITY A CONTI- <br />GUOUS TRACT OF LAND CONTAINING APPROXIMATELY 6.178 <br />ACRES, LOCATED WITHIN THE EXTRATERRITORIAL JURIS- <br />DICTION OF SAID CITY AND LYING ADJACENT TO PRESENT <br />CITY BOUNDARIES; EXTENDING THE BOUNDARY LIMITS OF <br />SAID CITY SO AS TO INCLUDE SAID TRACT; GRANTING TO <br />THE INHABITANTS OF SAID TRACT ALL THE RIGHTS AND <br />PRIVILEGES OF OTHER CITIZENS OF THE ACTS AND' OR- <br />DINANCES, RULES AND REGULATIONS OF SAID CITY AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br /> WHEREAS, the City Council of the City of San Marcos, Texas, <br />provided an opportunity for all interested persons to be heard at a <br />public hearing on April 27, 1981, on the annexation by the City of <br />San Marcos, Texas of 6.178 acres of land, adjOining the existing <br />city limits of said city, out of the J. M. Veramendi League No. Two, <br />Abstract 17, and being more particularly described by ~etes and <br />bounds as follows: <br /> <br />6.178 acres in the J. M. Veramendi League No. Two, <br />Abstract 17, being a portion of that tract of 100.13 <br />acres of land conveyed to Frank Sharp by B. F. Harper, <br />et al, by Deed dated August 9, 1947, and recorded in <br />Volume 138, Page 638, Hays County Deed Records, and <br />more particularly described as follows: <br /> <br />COMMENCING at an iron pin in the Southeast street <br />line of River Road (Old S. H. 80) said iron pin marks <br />the intersection of the Southeast street line of River <br />Road and the Northeast line of a 30' R.O.W. to the <br />City of San Marcos Sewer Plant, and also being the most <br />Western corner of the parcel herein described. <br /> <br />THENCE, along the Southeast street line of River Road, <br />along an existing fence, N. 45 deg. 03' E., a distance <br />of 208.71' to an iron pin, said iron pin marks the most <br />Northern corner of the parcel herein described. <br /> <br />THENCE, S. 45 deg. 00' E., a distance of 1288.24' to an <br />iron pin set on the Northwest line of a '30' R.O.W., said <br />iron pin marks the most Easterly corner of the parcel <br />herein described. <br /> <br />THENCE, S. 45 deg. 00' W., along the Northwest line of <br />the 30' R.O.W. a distance of 208.71' to a small spike <br />set in the center of a fencepost, said spike is the <br />most Southern corner of the. parcel herein described, and <br />also marks the intersection of the Northwest line of a <br />30' R.O.W. and the Northeast line of another 30' R.O.W.; <br /> <br />THENCE, N. 45 deg. 00~ W., along a fence, line, along the <br />Northeast line. of thel previously mentioned 30~ R,O.W. a <br />distance of 1288.42~ to an iron pin, said iron pin marks <br />the POINT OF BEGINNING, containing 6,178 acres of land; <br />and, <br /> <br /> WHEREAS, notice of said public hearing was published in <br />the San Marcos Daily Record, a newspaper having general circulation <br />in said city and in the territory proposed to be annexed, on April <br />17, 1981, a date not more than twenty (20) days nor less than ten <br />(10) days prior to said hearing; and, <br /> <br /> WHEREAS, said 6.178 acres are located within the extrater- <br />ritorial jurisdiction of the City of San Marcos, Texas, and not with- <br />in the extraterritorial jurisdiction of any other city; and, <br /> <br /> <br />
