111 <br /> <br />MINUTES OF THE EMERGENCY MEETING OF THE <br />CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, JULY 9, 1981 <br /> <br />PRESENT: Mayor Pro-Tem <br /> <br />Berry R. Womack <br />Barbara Edwards <br /> <br />Also Present: Jeff Watkins, Greg Echols and Dr. Ken Long. <br /> <br />The Mayor Pro-Tem called the meeting to order at 4:00 o'clock p.m. <br /> <br />Joel Barnard, Chairman of the Planning and Zoning Commission, was <br />aSked to give a brief summary in regard to the Holland Hills Town- <br />house project with developer Chester Witte. Mr. Barnard said when <br />the Planning and Zoning Commission requested the City Council to <br />rezone the property in question (in Holland Hills Subdivision) to <br />a Townhouse District, they felt San Marcos was in need of a good <br />townhouse project. Mr. Barnard indicated he felt the current subdi- <br />vision ordinance that deals with townhouses is inadequate. Planning <br />and Zoning had thought about a townhouse project on three or four <br />lots in an established area with eight townhouses in a row, then a <br />green area in between another eight townhouses in a row. Planning <br />and Zoning had not thought about a maximum townhouse construction on <br />a ten acre tract of land of approximately 80 units, as Mr. Witte <br />brought to them. At that point P and Z began to have concerns of <br />the slope of the property and runoff that is there now, the natural <br />drainage that occurs there and at other homes in the area around the <br />property in question and about the appropriateness of an 80 unit <br />townhouse project. When P and Z first requested City Council to <br />rezone the property for townhouse construction, it was their under- <br />standing that the Lutheran Church near the property did not oppose <br />the townhouse project but later they found out that indeed the Church <br />opposed the project and still opposes it. P and Z then received a <br />report from some of the neighborhood of bad water pressure in the <br />area. P and Z requested George Boeker to check the water pressure <br />before they made a decision to rezone the property to townhouse. Mr. <br />Boeker's report stated the pressure was adequate and would continue <br />to be adequate. Some of the members of P and Z felt the rezoning <br />needed to be approved regardless because the minimum standards had <br />been met, and other members of P and Z did not want to approve a re- <br />zoning of the property because certain concerns were not being met, <br />such as density and runoff. Their vote was to disapprove the plat. <br />Mr. Barnard came before the City Council at that point realizing the <br />P and Z commission needed to submit something specific to the Council. <br />At a recent P and Z' meeting they decided to place the matter on their <br />agenda to Propose rezoning of the property to "R-i". During the first <br />of the process, Mr. Barnard talked with the developer indicating he <br />felt a townhouse project would be good for thfs property, but that <br />80 units were not appropriate but possibly 40 units would be. P and <br />Z did get an environmental statement from the Environmental Advisory <br />Board whereiln they expressed some concerns but their recommendations <br />were not enough to disapprove the plat. <br /> <br />Mrs..Norris moved that Council go into an executive session pursuant <br />to Section 2(e), Art. 6252-17, V.A.C.S., to discuss pending litigation <br />and Mrs. Mendez seconded the motion, which passed unanimously. <br /> <br /> <br />
