<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
<br />SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT
<br />ORDINANCE WHICH REGULATES AND RESTRICTS THE LO-
<br />CATION AND USE OF BUILDINGS, STRUCTURES AND LAND,
<br />DATED SEPTEMBER 29, 1980 (VOL. 54) BY CHANGING
<br />THE ZONING OF PARTS OF LOT NOS. 9, 10 AND 11 IN
<br />BLOCK NO. 4 AND PART OF LOT NO. 1 IN BLOCK NO. 5
<br />OF THE H. E. BARBER ADDITION, LOCATED ON QUARRY
<br />STREET, FROM "P" (PUBLIC USE) TO "TH" (TOWNHOME
<br />DISTRICT).

<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />That the following described piece of real property located in San
<br />
<br />Marcos, Hays County, Texas, which is presently zoned "P" (Public
<br />
<br />Use) henceforth shall be rezoned, such rezoning to be effective
<br />
<br />after legal passage of this Ordinance and publication in a newspaper
<br />of general circulation in the area.
<br />
<br />Parts of Lot Nos. 9, 10 and 11 in Block No. 4
<br />and part of Lot No. 1 in Block No. 5 of the
<br />H. E. Barber Addition, further described by
<br />metes and bounds as follows:
<br />
<br />Ail that certain real property in the City of
<br />San Marcos, in Hays County, Texas, being a part
<br />of Lot Nos. Seven (7), Eight (8) and Nine (9) in
<br />Block No. Four (4), and other parts, of the H. E.
<br />Barber Addition to the City of San Marcos, in
<br />Hays County, Texas, according to the map or plat
<br />thereof recorded in Volume "W", Page 336, Hays
<br />County Deed Records, and being that same iden-
<br />tical real property conveyed by and described
<br />in Deed from Charles H. Bass and Hallie Davis
<br />Bass to Edwin D. Gunter'and Gloria M. Gunter,
<br />dated August 3, 1949, recorded in Volume 144,
<br />Pages 270-272, Hays County Deed Records, and
<br />the same real property is more accurately de-
<br />scribed by metes and bounds as follows:
<br />
<br />BEGINNING at an iron pipe for the most Northern
<br />corner of the Yancy P. Yarbrough lot, same be-
<br />ing a-point in the Southwest line of a 30 foot
<br />street which beginning point bears N. 44 deg. 07'
<br />W. 150.0 feet from an iron pipe for the South in-
<br />tersection of the said 30 foot street with the
<br />Northwest line of Hutchison (or Belvin) Street.
<br />The iron pipe at the South intersection of the
<br />30-foot street with the Northwest line of Hutchi-
<br />son (for Belvin) Street bears S. 43 deg. 21t W.
<br />100.0 feet from an iron pipe found on the ground
<br />for the location of the South. corner of LOt No.
<br />Five (15), Block No. Four (14) of the H. E. Barber
<br />Addition to the City of San Marcos, according to
<br />a survey made on the ground by S. M. Sewell on
<br />June 29, 1937, recorded in Volume 116, Page 413,
<br />Hays County Deed Records. The said 30 foot street
<br />was conveyed by and described in Deed from Charles
<br />H. Bass and wife, to the City of San Marcos, dated
<br />August 17, 1938, recorded in Volume 117, Pages
<br />285-286, HaYs County Deed Records;
<br />
<br />THENCE N. 44 deg. 07' W. 217.5 feet with the South-
<br />west line of said 30 foot street to an iron pipe at
<br />the South intersection of Quarry Street, as Quarry
<br />Street is now located;
