RESOLUTION NO. 2010-89R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING A UTILITY ADJUSTMENT <br />AGREEMENT BETWEEN THE CITY OF SAN MARCOS, TEXAS AND <br />ENTERPRISE PRODUCTS OPERATING, L.L.C. (THE `OWNER ") IN <br />THE AMOUNT OF $330,646.00, FOR THE PURPOSE OF ENABLING <br />THE OWNER TO PROTECT ITS GAS PIPELINE FACILITIES FROM <br />CHANGED CONDITIONS RESULTING FROM THE MCCARTY LANE <br />IMPROVEMENTS; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE SAID AGREEMENT; AND DECLARING AN EFFECTIVE <br />DATE. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The terms and conditions of the attached Utility Adjustment Agreement <br />(the "Agreement ") between the City of San Marcos, Texas and Enterprise Products Operating, <br />L.L.C. are hereby approved. <br />PART 2. The City Manager, Rick Menchaca, is authorized to execute the <br />Agreement on behalf of the City. <br />• PART 3.
