• RESOLUTION 2008-125R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF THE FIRST <br />AMENDMENT TO DEVELOPMENT BETWEEN THE CITY AND POST ROAD <br />PARTNERS, L.L.C FOR THE CONSTRUCTION OF PUBLIC INFRASTRUCTURE <br />IMPROVEMENTS INCLUDING A STORM DRAINAGE SYSTEM TO SERVE THE <br />MARLTON ESTATES SUBDIVISION AND ADJACENT PROPERTY; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON <br />BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />PART 1. The attached First Amendment To Development Agreement between the City <br />and Post Road Partners, L.L.C. for the construction of public infrastructure improvements including a <br />storm drainage system to serve the Marlton Estates Subdivision is hereby approved. <br />PART 2. The City's cost participation shall not exceed $95,692.00 for construction of the <br />public improvements and $20,432 for engineering. <br />PART 3. The City Manager, Rick Menchaca, is authorized to execute the Agreement on <br />• behalf of the City. <br />PART 4.
