<br />59. <br /> <br />RESOLUTION 2004-118 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS APPROVING AN EMERGENCY CONSTRUCTION CONTRACT <br />WITH DU-MOR ENTERPRISES, INC. FOR THE RANCH ROAD 12 - 16" <br />WATER LINE EMERGENCY REPLACEMENT PROJECT; AUTHORIZING <br />THE CITY MANAGER TO EXECUTE THE CONTRACT DOCUMENTS ON <br />BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. Widening of Ranch Road 12 by the Texas Department of Transportation <br />(UTxDOT") requires the lowering of approximately 280 linear feet of 16" water line near <br />Craddock Avenue to provide sufficient cover between the water line and the proposed <br />ditch. <br /> <br />2. TxDOT has opened bids for its project and anticipates beginning construction <br />in late July or early August of 2004. <br /> <br />3. It is necessary to have the work completed by Du-Mor Enterprises, Inc. on <br />an emergency basis without formal competitive bidding in order to preserve and protect <br />the public health and safety of the City's residents. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The award of an emergency contract to Du-Mor Enterprises, Inc. for <br />the Ranch Road 12 - 16" Water Line Emergency Replacement Project in the amount of <br />$38,320.00 is approved. <br /> <br />PART 2. The City Manager, Dan O'Leary, is authorized to execute the contract <br />documents on behalf of the City. <br /> <br />PART 3.
