<br />ORDINANCE NO. 2004- 17 <br /> <br />100. <br />0 ~ <br />~o Co- <br />c: <br />~::¡ :z <br />cn-< ~ <br />PJO Q1 ~m <br />::Ir <br />3:m f"..J ¡-g <br />s»:Jj C) <br />a" C) <br />.þ. <br />0 3: <br />(I) <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT <br />OF LAND CONTAINING 103.788 ACRES, MORE OR LESS, <br />LOCATED IN THE 1400 - 1900 BLOCKS OF STATE <br />HIGHWAY 21 (BLANCO RIVER VILLAGE TRACT); <br />APPROVING A SERVICE PLAN FOR THIS TRACT; AND <br />INCLUDING PROCEDURAL PROVISIONS. <br /> <br />RECITALS: <br /> <br />1. The City Council of the City of San Marcos, Texas, provided an opportunity for all <br />interested persons to be heard at two public hearings, held on June 21, 2004 <br />and on June 28, 2004 , to consider the proposed annexation by the City of 103.788 <br />acres, more or less, located in the 1400 - 1900 blocks of Highway 21, in Rays County, Texas (the <br />"Annexation Area"), consisting of the tract of land described by metes and bounds in the <br />attached Exhibit A. <br /> <br />2. The City has received a petition for annexation from the owner(s) of the property <br />included in the Annexation Area, a copy of which is attached as Exhibit B. <br /> <br />3. An on-site public hearing has not been requested in writing by more than 10% of the <br />adults who are permanent residents of the Annexation Area. <br /> <br />4. A notice of each of the public hearings was published in the San Marcos Daily <br />Record, a newspaper having general circulation in the City and in the Annexation Area, on <br />June 10. 2004 and .Tune 17. 2004 , these dates being on or after the 20th <br />day and before the 10th day before the date of the respective hearings. A notice of each of the <br />public hearings was also posted on the City's Internet web site on or after the 20th day and before <br />the 10th day before the date of the respective hearings, and these notices remained posted on the <br />website until the dates of the respective hearings. <br /> <br />5. Prior to the publication of the notices ofthe public hearings, the City Council directed <br />preparation of a service plan that provided for the extension of municipal services to the <br />Annexation Area. <br /> <br />6. The proposed service plan was made available for inspection and explained to the <br />residents, if any, of the Annexation Area at the public hearings. <br /> <br />7. The Annexation Area is contiguous and adjacent to the current boundaries ofthe City. <br /> <br />8. The annexation of the Annexation Area would cause an area to be surrounded to be <br />surrounded by the City and not included within the city limits, and the City Council finds and <br />determines that this is in the public interest on the basis that the area to be surrounded by the City <br />through this annexation is not proposed for development at the present time and the provision of <br />
