<br />ORDINANCE NO. 2004 - 38 <br /> <br />108. <br />0 ~ <br />-<0 '- <br />c ªJJ <br />0- z <br />--i <br />cn-< ...... <br />s»o -ï <br />~r ~ ¡s.m <br />ลก:m I'V ~O <br />s»:D C) <br />ö^ C) ~ <br />0 .þ. <br />,0 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS APPROVING THE SALE OF <br />A PORTION OF LOT 8, BLOCK 2, KATY ADDITION, <br />LOCATED IN AN UNOPENED PORTION OF THE 300 <br />BLOCK OF McGEHEE STREET, TO WILLIAM <br />CHRISTOPHER CARSON; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE A DEED; AND INCLUDING <br />PROCEDURAL PROVISIONS. <br /> <br />RECITALS: <br /> <br />1. The City is the owner of a portion of Lot 8, Block, 2, Katy Addition, located in an <br />unopened portion of the 300 Block of McGehee Street. <br /> <br />2. A staff analysis has been made that has determined that there is no pres~nt or anticipated <br />future need for the City to retain this property. <br /> <br />3. The City has complied with the requirements of Section 272.001(b)(1) of the Texas Local <br />Government Code regarding the sale of surplus real property by sealed bidding, and the high bidder <br />for the purchase of this tract of property is William Christopher Carson. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. The sale of the parcel of real property described in Recital 1 above to William <br />Christopher Carson is approved. <br /> <br />SECTION 2. The City Manager, Dan O'Leary, is authorized to execute the attached Special <br />Warranty Deed conveying to William Christopher Carson the property described above. <br /> <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph ofthis ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in full force if they can be given effect without the invalid portion. <br /> <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br /> <br />SECTION 5. This Ordinance will take effect 10 days after the date of its final passage, and <br />the City Clerk will publish notice of its adoption in a newspaper of general circulation in the City. <br /> <br />PASSED AND APPROVED on first reading June 28, 2004. <br /> <br />PASSED AND APPROVED ON second reading July 12, 2004. <br />
