0 RESOLUTION 2008-137R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ADOPTING A CITY OF SAN MARCOS IDENTITY THEFT <br />PREVENTION PROGRAM; AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The Federal Trade Commission has adopted Identity Theft Rules (the "Rules") <br />which implement Section 114 of the Fair and Accurate Credit Transactions Act of 2003, 16 <br />C.F.R. Section 681.2 and which require every financial institution and creditor to establish an <br />identity theft program tailored to the size, complexity and nature of its operation. <br />2. In accordance with these Rules, the City wishes to establish an Identity Theft <br />Prevention Program (the "Program") which contains reasonable policies and procedures to <br />identify relevant identity theft indicators ("Red Flags") for new and existing accounts and to <br />incorporate those Red Flags into the Program; detect Red Flags that have been incorporated into <br />the Program; respond appropriately to any Red Flags that are detected to prevent and mitigate <br />identity theft and to ensure that the Program is updated periodically to reflect changes in risks to <br />customers and to the safety and soundness of the creditor from identity theft. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />• TEXAS: <br />PART 1. The attached City of San Marcos Identity Theft Prevention Program is <br />approved and adopted. <br />PART 2.
