<br />114 <br /> <br />RESOLUTION NO. 2004------12-8R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS APPROVING AMENDMENT NO.2 TO <br />THE AGREEMENT WITH TEXAS DISPOSAL SYSTEMS, INC. <br />FOR COLLECTION AND DISPOSAL OF RESIDENTIAL SOLID <br />WASTE AND RECYCLABLE MATERIALS; AUTHORIZING <br />THE CITY MANAGER TO EXECUTE THE AMENDMENT; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City Council approved an agreement (the "Agreement") with Texas Disposal Systems, <br />Inc. ("TDS") for residential solid waste and recyclable materials collection and disposal on April 14, <br />2003. <br /> <br />2. The City and TDS wish to amend the Agreement to adjust the monthly rate for basic <br />residential service based on changes in the Consumer Price Index, in accordance with Section 3.3 of <br />the Agreement. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The terms and conditions of the attached Amendment No.2 to the Agreement for <br />residential solid waste and recyclable materials collection and disposal services between the City and <br />Texas Disposal Systems, Inc. is approved. <br /> <br />PART 2. The City Manager, Dan O'Leary, is authorized to execute the attached amendment <br />on behalf of the City. <br /> <br />P ART 3.
