<br />ORDINANCE NO. 2004- 45 <br /> <br />1576 ~ <br />;::; 3: <br />'<0 ~ <br />0- <br />--f <br />00-< ..... qr <br />1»(') -.:¡ s-f <br />~r <br />s:m "" ~t <br />I»::D c;::) ~ <br />ò" c;::) <br />.þo <br />0 <br />rn <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT <br />OF LAND CONT AINING 326 ACRES, MORE OR LESS, <br />LOCATED ADJACENT TO AND NORTH OF THE RIDGE AT <br />STONECLIFF AND THE WILLOW CREEK SECTION 9 <br />SUBDIVISIONS (NORTH OF THE 2200-2600 BLOCKS OF <br />SUMMIT RIDGE DRIVE) (PURGATORY GREENSPACE <br />TRACT); APPROVING A SERVICE PLAN FOR THIS TRACT; <br />AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />RECITALS: <br /> <br />1. The City Council of the City of San Marcos, Texas, provided an opportunity for all <br />interested persons to be heard at two public hearings, held on June 14, , 2004, <br />and on June 21, , 2004, to consider the proposed annexation by the City of <br />326 acres, more or less, located along and adjacent to the Ridge at Stonecliff and the Willow <br />Creek Section 9 Subdivisions, noIíh of the 2200-2600 Blocks of Summit Ridge Drive (Purgatory <br />Greenspace Tract), in Hays County, Texas, consisting ()f the tract of land described by metes and <br />bounds in the attached ExhiÞi1: A (the "Annexation Area"). <br /> <br />2. The City has received a petition for annexation from the owner of the property in the <br />Almexation Area, a copy of each of which is attached to this ordinance as Exhibit B. <br /> <br />3. An on-site public hearing has not been requested in writing by more than 10% of the <br />adults who are permanent residents of the Annexation Area. <br /> <br />4. A notice of each of the public hearings was published in the San Marcos Daily <br />Record, a newspaper having general circulation in the City and in the Annexation Area, on <br />May 28, ,2004 and June 4, ,2004, these dates being on or after <br />the 20th day and before the 10th day before the date of the respective hearings. A notice of each <br />ofthe public hearings was also posted on the City's Internet website on or after the 20th day and <br />before the 10th day before the date of the respective hearings, and these notices remained posted <br />on the website until the dates of the respective hearings. <br /> <br />5. Prior to the publication of the notices of the public hearings, the City Council directed <br />preparation of a service plan that provided for the extension of l1llmicipal services to the <br />Almexation Area. <br /> <br />6. The proposed service plan was made available for inspection and explained to the <br />residents, if any, of the Annexation Area at the public hearings. <br /> <br />7. The Amlexation Area is contiguous and adjacent to the current boundaries of the City. <br /> <br />8. Notice of all meetings of, and all deliberations of, the City COlillcil involving the <br />
