• RESOLUTIOW,IRO. 2009-1 R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS. APPROVING AN AMENDMENT TO THE <br />CAPITAL IMPROVEMENT AGREEMENT WITH SLC 61 JOINT <br />VENTURE TO PROVIDE FOR THE CITY'S EXPENDITURE OF <br />$275,546.95 AS PARTICIPATION IN THE CONSTRUCTION OF <br />COTTONWOOD CREEK PARKWAY; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE THE AGREEMENT; AND DECLARING <br />AN EFFECTIVE DATE. <br />RECITALS: <br />1. On June 19, 2007, the City entered into a Capital Improvement Agreement <br />with SLC 61 Joint Venture for improvements to the Cottonwood Crossing subdivision. <br />That agreement provided for the donation of land by SLC 61 Joint Venture to the City, <br />along with the construction of certain infrastructure. <br />2. As part of the overall consideration for the agreement, and for the receipt of <br />the property, the City agreed to participate in the construction of Cottonwood Creek <br />Parkway. SLC 61 Joint Venture bid the project, and in accordance with the 2007 <br />Agreement the City's share for the construction of Cottonwood Creek Parkway is <br />• $275,546.95. - <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The attached agreement, between the City of San Marcos, Texas and <br />SLC 61 Joint Venture is approved. <br />PART 2. The City Manager, Rick Menchaca, is authorized to execute the <br />agreement on behalf of the City. <br />PART 3.
