RESOLUTION 2010- - 119 R. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AMENDMENT NO. 1 TO THE LOCAL TRANSPORTATION PROJECT ADVANCE FUNDING AGREEMENT FOR A SURFACE TRANSPORTATION PROGRAM-METROPOLITAN MOBILITY PROJECT (ON SYSTEM) BETWEEN THE CITY AND THE STATE OF TEXAS ACTING THROUGH THE TEXAS DEPARTMENT OF TRANSPORATION FOR THE CONSTRUCTION OF A SOUTHBOUND RAMP ONTO I -35 AT RIVER RIDGE; APPROVING AN INCREASE IN THE CITY'S COST PARTICIPATION FROM $2509000.000 TO $721,115.00; AUTHORIZING THE INTERIM CITY MANAGER TO EXECUTE THIS AMENDMENT NO. 1 TO THE ADVANCED FUNDING AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. On November 17, 2009, the City approved an Advance Funding Agreement (AFA) with the State of Texas, acting through the Texas Department of Transportation ( "TxDOT ") for a Surface Transportation Program - Metropolitan Mobility Project (On System) for the I-35 Ramps at River Ridge Project CSJ ##0016 -02 -122 (the "Project "). 2. The AFA executed by both the City and TxDOT indicated that the City's cost participation for this Project was $250,000.00. 3. The Project Budget has been revised to update the total cost estimate of the Project and to include payment of direct state costs, therefore, it is necessary to increase the City's cost participation in the Project from $250,000.00 to $721,115.00. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCO S, TEXAS PART 1. The attached Amendment No. 1 to the Local Transportation Project Advance Funding Agreement for a Surface Transportation Program - Metropolitan Mobility Project (On System) between the City and the State of Texas Acting through the Texas Department of Transportation for the construction of the Project is approved. PART 2. An increase from $250,000.00 to $721,115.00 in the City's cost participation for the Project is approved. 1
